Äldreombudsmannen - en studie av behovet för en ny tematisk ombudsman?

I Sverige har begreppet ombudsman varit en del av vår myndighetsapparat sedan 1800-talet och har kommit att bli en stor exportvara.
Ombudsmannens uppgift har varit att tillförse att lagutövande makter höll sig inom lagens gränser och på så sätt blev detta en garant offentliga myndigheters upprätthållande av grundlagsstadgade principer om saklighet och objektivitet vid myndighetsutövande och beaktandet av individens grundläggande fri- och rättigheter.

Under senare decennier har flertalet tematiska ombudsmän installerats i syfte att tillse att viss lagstiftning mot diskriminering för en skyddsvärd grupp eller minoritet efterlevs. Ombudsmännens uppgifter har inte endast omfattat en klagoinstans och processförare i enskilda fall utan... (More)

Ombudsmannens uppgift har varit att tillförse att lagutövande makter höll sig inom lagens gränser och på så sätt blev detta en garant offentliga myndigheters upprätthållande av grundlagsstadgade principer om saklighet och objektivitet vid myndighetsutövande och beaktandet av individens grundläggande fri- och rättigheter.

Under senare decennier har flertalet tematiska ombudsmän installerats i syfte att tillse att viss lagstiftning mot diskriminering för en skyddsvärd grupp eller minoritet efterlevs. Ombudsmännens uppgifter har inte endast omfattat en klagoinstans och processförare i enskilda fall utan även, och någon gång endast, innefattat en opinionsbildande och rådgivande roll med inflytande över rådande politiska tankegångar och lagstiftningsbehov och innehåll.

Sveriges äldrepolitik är ett aktuellt ämne men mycket eftersatt. Forskning, utredningar, lagstiftning och insatser för de äldre är bristande och ofta bristfälliga. Äldres engagemang och inflytande i både det politiska livet och det mediala sammanhanget lämnar mycket att önska.
Lagstiftningen och konventionsstadganden som riktas till äldres förhållanden rör ofta formella stadganden om rättigheter eller värdegrunder. Äldre omfattas också av diskrimineringslagstiftning och flertalet reformer har genomförts de senaste decennierna i syfte att tillförse dem med valfrihet och alternativ beträffande vård och boende.

Om vi utgår från empiriska data skulle ett rättfärdigande av en äldreombudsman innebära att gruppen äldre skulle anses vara skyddsvärd såtillvida att specifik lagstiftning var i behöv av tillsyn för efterlevnad, alternativt att gruppen i sig behövde en ombudsman avsedd att tillse dess intressen och behov i förhållande till samordning av insatser och lagstiftningsärenden och efterlevnad.

Med utgång i Matha Finemans teori om sårbarhet finnes ett visst fog för tillsättandet av en ombudsman för gruppen äldre. Enligt henne är människans sårbarhet universell och inte beroende av tillhörighet till viss grupp så som skyddslagstiftning ofta är konstruerad. Ålderdomens tillstånd är i högsta grad universellt och tillika ett tillstånd eller en passage som innebär många förändringar och därför en speciell utsatthet för just sårbarheten.

I en tid då äldrepolitiken aldrig varit viktigare och ämnet så eftersatt finner jag det lämpligt att tillsätta ett organ som kan tillse de värden som för äldre är av vikt. (Less)

The Ombudsman's task has been to provide the law performer powers held within the law and so this became a guarantor of public authorities maintaining the constitutional principles of impartiality and objectivity in the exercise of authority and the consideration of the individual's fundamental rights and freedoms .

Sweden's policy for the elderly is a current topic but highly neglected. Research, investigations, legislation and actions for the elderly is inadequate and often flawed. Older people's involvement and influence in both politics and the media context leaves much to be desired.
Legislation and enactment of Conventions targeted at elderly conditions often relate formal provisions on the rights or values of the legislation. Elderly are also covered by discrimination legislation and several reforms have been made in recent decades in order to provide them with choice and options regarding health care and housing.

If we start from the empirical data, a vindication of a senior ombudsman mean that the group of elderly would be considered worthy of protection in that specific legislation was required by regulatory compliance, or that the group itself had an Ombudsman designed to ensure its interests and needs in relation to coordination of efforts and legislative issues and compliance.

Based on Martha Fineman's theory of vulnerability, some reason exists for the appointment of an ombudsman for older people. According to her, human vulnerability is universal and does not depend on affiliation with a particular group such as protective legislation often is constructed. The conditions of the state of old age are highly universal and also a state or a passage that involves many changes and therefore a time during which one is especially exposed to a state of vulnerability.

At a time when policy for the elderly has never been more important and the subject so neglected, I find it appropriate to appoint an agency to ensure the values for the elderly is of importance. (Less)
