Bevisprövning i flyktingärenden: Hur utlänningars utsagor blir till bevismedel?

- Uppmärksamheten rörande flyktingfrågan tenderar att beröra människor på olika sätt. Det kan få dess effekter på gott och ont. Jag har valt att koncentrera mig på en mer påtvingad invandring som jag väljer att kalla det. Den påtvingade aspekten på det menar jag är människors flykt från dess hemländer, vilket får de att bli flyktingar av olika slag. Jag diskuterar där de olika grunder som kan bli aktuella vid bedömningen av att försöka fastslå den asylsökandes asylgrund. Dessutom så problematiseras situationen, när myndigheter och domstol ska försöka utröna och analysera den sökandes berättelse som de har att utgå ifrån.

Sedermera tillkommer de andra verktygen som måste behandlas i samband med den sökandes berättelse, det kan vara landinformation som måste gås igenom, ordentliga tolkar, ombud och självfallet skall kompetensen hos de beslutande myndigheterna ligga högt när besluten rör människoliv och dess öden. Slutsatsen av detta är att själva handläggningen utgör enligt mig en viktig del i bevisprövningen i sådana här ärenden.
Jag har valt att ta med de olika aspekterna i min huvudfråga angående bevisprövningen för att visa på att de påverkar till den graden att det kan ha en stark inverkan på ett bifall eller avslag i slutändan hos den beslutande myndigheten. Rättsfallsundersökningen finns med för att ge uppsatsen en praktisk dimension. Den visar hur de olika verktygen används i samspel med den sökandes utsaga och domstolens bedömning. (Less) - Abstract
- The attention regarding the refugee issue tends to affect people in different directions. It has its effect in both a good and bad way. I have chosen to concentrate on what i call a forced migration. The forced aspect in this subject is those people fleeing from their respective homelands, which ends up resulting in that these people become refugees of different kind. I will discuss the bases which will be important to determine the asylum seekers future. The process becomes more complexed when authority and the court wants to evaluate and analyse the refugees background story.
There are other tools that need to be involved in the process associated with the refugees background story. Those tools are; information on different countries... The forced aspect in this subject is those people fleeing from their respective homelands, which ends up resulting in that these people become refugees of different kind. I will discuss the bases which will be important to determine the asylum seekers future. The process becomes more complexed when authority and the court wants to evaluate and analyse the refugees background story.
There are other tools that need to be involved in the process associated with the refugees background story. Those tools are; information on different countries relevant to the asylum seekers, skilled interprets, attorneys, and last but not least on the decision-making authorities whose decisions will change the lives for those people who has fled for their lives. The conclusion is that the processing is coming out to become a very important part of the assesment of evidence in these kind of cases.
I have chosen to bring up these different aspects in my work regarding assesment of evidence to show the reader how influencial these are on an approval or refusal in the end. The legal case investigation are included in my essay to show an practical dimension. The investigation will show how all the different tools interact with the asylum seekers story and the courts decision. (Less)
