- Säkerhetsrådet ska i enlighet med art. 39 FN-stadgan vidta kollektiva åtgärder för att bevara den internationella freden och säkerheten. Säkerhetsrådet kan inom ramen för detta uppdrag vidta militära och icke-militära åtgärder under stadgans kapitel VII. För att Säkerhetsrådet ska kunna agera krävs att de fem permanenta medlemmarna Frankrike, Kina, Ryssland (Sovjetunionen), Storbritannien och USA är överens om vilka åtgärder som behöver vidtas. En permanent medlem som inte godkänner en åtgärd kan lägga ett veto. Detta veto innebär att Säkerhetsrådet inte kan agera i den aktuella frågan. Inom ramen för denna uppsats har doktrinen om humanitär intervention studerats som ett sådant argument.
Behövs det en reform av Säkerhetsrådet? I uppsatsen behandlas Säkerhetsrådets utformning och hur denna kan förändras för att bättre tillvarata FN-stadgans syfte med Säkerhetsrådet. I fokus för uppsatsen, som bygger på konventionstexter och litteratur, står även två rättsfall där Säkerhetsrådet varit oförmöget eller ovilligt att agera. Kan dessa rättsfall visa på att en rätt till humanitär intervention verkligen existerar?
Slutsatserna författaren kommer fram till är att det behövs en reform av Säkerhetsrådet både när det gäller rådets sammansättning och vetorätten. Att fem medlemmar av Säkerhetsrådet ska privilegieras överensstämmer inte med FN:s utveckling. Det finns ingen rätt till humanitär intervention i ett de lege lata-perspektiv, men det kan argumenteras för en sådan rätt i ett de lege ferenda-perspektiv. (Less) - Abstract
- The Security Council shall, according to Article 39 of the UN Charter, take collective measures to preserve the international peace and security. The Council can, within the framework of this commission, take military and non-military actions according to Chapter VII of the Charter. In order for the Security Council to take action, the five permanent members France, China, Russia (the Soviet Union), Great Britain and USA, have to agree. A permanent member, who does not approve on the action, can cast a veto. The veto will hinder the Security Council to act on the matter. Within the framework of this thesis, the doctrine of human intervention has been studied as such an argument.
Is there a need for a reform of the UN Security Council? In this thesis the formation of the Council is discussed and how this could change to live up to the purposes of the UN Charter. The focus of the thesis, which is based upon convention texts and literature, lies on two court cases where the Security Council has been unable or unwilling to act. Do these cases prove that a right to human intervention truly exists?
The conclusions drawn by the author are that there is a need of a reform of the UN Security Council, both regarding its structure and the right to veto. The privilege of the five permanent members of the Security Council is not consistent with the development of the UN. There is no right to human intervention in a de lege lata perspective, but possibly in a de lege ferenda perspective. (Less)
