- Abstract (Swedish)
(Less) - Abstract
- The recruitment and use of child soldiers is regulated in, among other instruments, TP I and II and in the child convention and it’s optional protocols. There are also various resolutions from the security council on the topic. Together these instruments provide children in armed conflict with some protection. Unfortunately, despite the regulations in international law, children are used in conflicts on a daily basis. The perpetrators are both states and non-state actors.
This paper aims to account for the protection of child soldiers in international law, and also describe the UN:s work with stopping actors from recruiting and using child soldiers. This paper aims to account for the protection of child soldiers in international law, and also describe the UN:s work with stopping actors from recruiting and using child soldiers. The paper focuses on IHL and human rights and the protection that falls within these legal branches of international law. The paper also explains why children are used in armed conflict and how the conflicts of today are different than what they were 50 years ago.
The applicable regulations are critisized and suggestions are given on how the continued work of the UN should proceed. The paper is concluded with a discussion on the effectivity of the regulations where the motives behind the UN:s work is questioned and the purpose of IHL is also discussed. (Less)
