Brister hedern i omsorgen? En fråga m hedersproblematiken kan vara vårdgrundande enliigt LVU såsom brister i omsorgen

Abstract (Swedish)

Uppsatsen syftar till att undersöka huruvida hedersproblematiska familjeförhållanden kan vara att likställa med brister i omsorgen i 2 § lag med särskilda bestämmelser om vård av unga (LVU) samt att undersöka om lagstiftningen har förmågan att tillgodose skyddet av flickor som lever i en hederskontext.

Heder är något som bara kan tillkomma män. Det är dock kvinnan i familjen som, så att säga, bär hedern eftersom huruvida den kan behållas intakt styrs av kvinnans beteende, framför allt det sexuella beteendet. Med anledning av att mannens heder styrs av kvinnans beteende får det till följd att mannen i stor utsträckning kontrollerar kvinnans liv och gör inskränkningar i detsamma.

LVU är en skyddslagstiftning till syfte att omhänderta barn som på något sätt far illa. Omhändertagandet kan ske på grund av att det föreligger missförhållanden relaterade till familjen och vårdnadshavarna, de så kallade miljöfallen i 2 § LVU. Det kan också handla om att det är den unge som genom sitt eget beteende utgör en fara för sig själv, de så kallade beteendefallen i 3 § LVU.

Av de domar som lagts till grund för uppsatsens utredning har det framkommit att flickor som lever i en hedersproblematisk situation i stort sett bereds vård. Det kan konstateras att hedersproblematiken är att se som brister i omsorgen när något annat rekvisit inte passar in. När flera rekvisit ansågs tillämpliga föll det som rörde hedersproblematiken ofta in under ett annat rekvisit medan omständigheter som tillkom till följd av hedersproblematiken föll under brister i omsorgen. Vidare kan konstateras att de flesta flickorna erhåller vård och mot bakgrund av det har jag således funnit att LVU-lagstiftningen är tillräcklig för att tillgodose vårdbehovet för flickor som lever i en hederskontext.

Abstract

This bachelor thesis aims to investigate whether honor problematic in family relationships can be the equivalent to inadequacy in care in § 2 teams with the Care of Young Persons (Special Provisions) Act (CYPA) and to investigate whether the legislation has the ability to cater to the protection of girls living in an honors context.

It´s only men who can have honor. But it´s the woman in the family who carries honor because her behavior, particularly sexual behavior, decides if the honor can be intact. That can be the reason to why the man control the life of the woman.

CYPA is a protective legislation designed to care for children in distress. CYPA uses when there is problem related to the family and guardians, called environmental case in § 2 CYPA. It can also uses when the problem attributable to the young person because of their own behavior, called behavior cases in § 3 CYPA.

To the judgments of the basis for the bechelor thesis investigation has revealed that girls living in a honor problematic situation mostely recive care. It is noted that honor problematic is to equating with inadequacy in care when any other prerequisite does not fit. When multiple prerequisite was considered appropriate seemed that concerned the honor problems often under a different prerequisite while circumstances which were added as a result of honor problems fell under the inadequacy in care.

Most of the girls who lives in an honors context recives care. Because of that I have founded that CYPA legislation is sufficient to meet the healthcare needs of girls living in an honors context.
