Pactum turpe - en rättssäker avvisningsprincip?

- Abstract
- The principle of pactum turpe exists as a general principle of law in Swedish law. The
principle says that contracts in conflict with law or good morals should be deemed
invalid, and that disputes based on these contracts should be refused from court. The
problem with this principle is that it denies claimants a full trial of their disputes based on
moral grounds that can be difficult to objectively ascertain and predict.
To apply this principle of law is according to my investigations allowed by the European
convention on human rights, but there are still reasons to think about alternative
solutions, especially considering the fact that I believe that a common moral standard in

apply their own morals to the decisions of the court. One solution to this problem is,
according to me, to in the form of law specify certain types of reprehensible contracts as
illegal and to adjust the results of other unfair contracts by using 36 § of the Swedish law

- Det rättsliga institutet pactum turpe, som i svensk rätt följer av allmänna rättsgrundsatser,
innebär att anspråk som bygger på avtal i strid mot lag eller god moral ska ogiltigförklaras
och avvisas av domstolarna, då det anses att rättsordningen inte ska befatta sig med vissa
typer av avtal. Det bakomliggande problemet med denna princip är att den förvägrar
sökande parter prövning av sina tvister på grund av moraliska skäl som kan vara svåra att
objektivt fastställa och förutse.
Att tillämpa detta institut är enligt min undersökning tillåtet enligt Europakonventionen,
men det finns ändå anledning att fundera över alternativa lösningar, särskilt med tanke på
