Skyldigheten att skydda- En undersökning av begreppet Responsibility to protect

Libyen, Rwanda, Irak och Syrien. Listan på humanitära kriser i världen kan göras lång där civilbefolkningen fått lida stora förluster. År 2001 uppkom ett nytt internationellt begrepp och princip, Responsibility to protect. Principen presenterade en ny syn på statssuveräniteten och blev mycket omdebatterad på grund av dess vaga utformning och karaktär. Responsibility to protect innebär den primära skyldighet som en stat har för att skydda sina medborgare vid grova kränkningsbrott. Skulle staten misslyckas med denna skyldighet faller den istället över på världssamfundet. Det finns därmed en sekundär skyldighet för andra stater att ingripa istället.

Principen presenterade en ny syn på statssuveräniteten och blev mycket omdebatterad på grund av dess vaga utformning och karaktär. Responsibility to protect innebär den primära skyldighet som en stat har för att skydda sina medborgare vid grova kränkningsbrott. I den här uppsatsen har jag gjort en undersökning om begreppet Responsibility to protect för att lära mig mer om dess utveckling. Syftet med uppsatsen var att göra en granskning av begreppet R2P och förklara hur skyldigheten att skydda har sett ut i både teorin och praktiken. Genom denna uppsats hoppas jag kunna reda ut R2P och ge en klarare syn på dess användningsområde.

Mina frågeställningar som har besvarats är vad begreppet innebär och hur långt det sträcker sig samt vem som får besluta kring Responsibility to protect. Slutligen har jag tagit upp vilka problemområden som finns gällande principen för att sedan gå vidare i en analys del där jag presenterar mina egna slutsatser.

Vad jag kommit fram till då studerat begreppet är att det är väldigt vagt i sin utformning. De dokument från FN och liknande som behandlar principen vill inte fullt ut sätta tydliga ramar för dess tillämpning. Gällande vem som får ta beslut för att principen ska aktualiseras ser det olika ut i teorin och praktiken. Uttryckligen är det Säkerhetsrådet och endast Säkerhetsrådet som får fatta beslut men i verkligheten har stater i vissa fall själva beslutat om interventioner. Problemområdena som finns har en bakgrund i att principen inte är tillräckligt tydlig. Den slutsats jag kom fram till är att principen trots sina brister är bra men att den måste utvecklas och göras tydligare för att den ska uppnå den standard som behövs! (Less)

In 2001 a new international concept and principle occurred to help with the prevention of these kinds of violations. The principle presented a new view to the State sovereignty and became highly debated due to its vague form and character. The Responsibility to Protect(R2P) entails that the primary duty of a government is to protect its citizens from gross violation offenses. If the State would fail, there is a secondary obligation for other States to intervene instead.

The principle presented a new view to the State sovereignty and became highly debated due to its vague form and character. The Responsibility to Protect(R2P) entails that the primary duty of a government is to protect its citizens from gross violation offenses. If the State would fail, there is a secondary obligation for other States to intervene instead.

In this essay I have made an investigation about the R2P to learn more about its development. The purpose of this paper was to make an examination of the concept of R2P and explain how R2P has worked in both theory and practice. Through this paper I hope to sort out R2P and give a clearer view of its application.

The questions I have answered is what the term means and who gets to authorize the principle. Finally, I have investigated the problem areas about principle and then in an analysis presented my own findings.

What I have come to see when studied the concept is that it is very vague to its from. The documents from the UN concerning this principle are not fully setting clear limits for its implementation. The appliance of R2P has been inconsequent in both theory and practice. It is explicitly stated that the Security Council is the only one allowed to act and give permission to authorize, but in reality States have at times themselves decided about interventions. The problem areas that exist have a background in that the principle is not clear enough. The conclusion I came to is that the principle despite its flaws is good, but it must be further developed and made clearer for it to achieve the standard that it needs! (Less)
