- En domstol är skyldig att genom s.k. materiell processledning verka för att ett mål blir tillräckligt utrett. Kravet gäller under hela rättegången och i alla instanser. Mitt syfte med denna uppsats är att fastställa hur långtgående materiell processledning i dispositiva tvistemål bör vara och vilka omständigheter som bör spela in när omfattningen av sådan processledning i enskilda fall bestäms.
Den materiella processledningens omfattning bör bestämmas med utgångspunkt i sådan processlednings syfte, som är att utforska parternas vilja, skydda en part från rättsförlust på grund av okunnighet eller förbiseende och säkerställa koncentrationen av huvudförhandlingen. Den materiella processledningens omfattning bör bestämmas med utgångspunkt i sådan processlednings syfte, som är att utforska parternas vilja, skydda en part från rättsförlust på grund av okunnighet eller förbiseende och säkerställa koncentrationen av huvudförhandlingen. Betydelse för omfattningen har också parternas rätt att fritt förfoga över processmaterialet och kravet på domstolens opartiskhet.
Rätten ska ta stor hänsyn till omständigheter i det enskilda fallet. Principiellt, men inte praktiskt, saknar det betydelse om en part har ett juridiskt ombud. Tvisteföremålets värde ska inte spela någon egentlig roll. Däremot påverkas processledningens omfattning av om tvingande regler är tillämpliga i tvisten. I ett sådant fall ökar kraven på materiell processledning.
I fråga om begränsande av onödigt processmaterial och rena förtydliganden går rättens skyldigheter långt. När det däremot gäller berikande av processmaterial krävs stor försiktighet från domstolens sida. Bara i mera självklara situationer bör rätten verka för nytt processmaterial.

My purpose with this paper is to determine the extent of this requirement in cases amenable to out-of-court settlement and to establish which circumstances should apply in individual cases.
The extent of the court’s investigation should be determined by the basis of such an investigation, which is to explore the parties’ intentions, to protect a party from loss of rights due to ignorance or oversight and to ensure the concentration of the main hearing. The parties’ right to dispose their trial and the requirement of the impartiality of the court are also of importance.

The extent of the court’s investigation should be determined by the basis of such an investigation, which is to explore the parties’ intentions, to protect a party from loss of rights due to ignorance or oversight and to ensure the concentration of the main hearing. The parties’ right to dispose their trial and the requirement of the impartiality of the court are also of importance.
The court has to consider the circumstances in the individual case. In principle, but not in practice, it is not of relevance whether a legal counsel represents a party. The amount at stake is of little significance. However, it is of importance whether mandatory rules are applicable. In such a case the demand on activity from the court increases.
The court has a far-going obligation to reduce the case by rejecting unnecessary circumstances and evidence and to clarify the parties’ positions. Regarding enrichment of circumstances and evidence the court needs to be very cautious. Only in more obvious situations, the court should propose a party to enrich the case.
The investigations from the court should be emphasized during the preparatory proceedings. (Less)
