- Uppsatsen behandlar de svenska häktningsreglerna, med betoning på förutsättningarna för häktning och rätten till domstolsprövning inom skälig tid, jämfört med rätten till frihet och säkerhet i Europakonventionen för mänskliga rättigheter. Syftet är att undersöka hur de svenska reglerna på området förhåller sig till Europakonventionen samt Europadomstolens praxis och särskilt om reglerna kan anses oförenliga på någon punkt.
I avhandlingens första del redogörs för de svenska reglernas utformning, särskilt vad gäller de krav som gäller dels för att häkta en misstänkt och dels för den misstänktes rätt till domstolsprövning. Syftet är att undersöka hur de svenska reglerna på området förhåller sig till Europakonventionen samt Europadomstolens praxis och särskilt om reglerna kan anses oförenliga på någon punkt.
I avhandlingens första del redogörs för de svenska reglernas utformning, särskilt vad gäller de krav som gäller dels för att häkta en misstänkt och dels för den misstänktes rätt till domstolsprövning. Häktningssystemet i Sverige, som saknar en fast tidsbegränsning, grundar den enskildes skydd mot godtycklig häktning i frekventa omprövningar av häktningsbeslutet, normalt sett var fjortonde dag. De fyra möjligheter till häktning av straffprocessuella skäl som systemet ger behandlas tillsammans med de tre etablerade häktningsgrunderna.
I den andra delen behandlas reglerna enligt Europakonventionen art. 5 samt hur de tolkats i Europadomstolens praxis. De olika delarna av art. 5 behandlas enskilt med betoning på de olika häktningsskälen i art 5.1c och rätten till domstolsprövning i art. 5.3.
Slutligen, efter en genomgång av ett antal viktiga domar, analyseras de svenska reglerna i jämförelse med Europakonventionen för att identifiera och redogöra för brister i Sveriges häktningssystem. (Less) - Abstract
- This thesis deals with the Swedish laws for pre-trial detention, particularly regarding the prerequisites and the right to trial within a reasonable time, compared to the right to liberty and security in the European Convention of Human Rights. The purpose of the thesis is to examine the Swedish rules regarding pre-trial detention and how they relate to the European Convention and the case law of the European Court of Human Rights, especially whether they can be said to be incompatible.
The first part of the thesis is comprised of an account of the Swedish rules on the prerequisites of pre-trial detention and the right to trial. (More) - This thesis deals with the Swedish laws for pre-trial detention, particularly regarding the prerequisites and the right to trial within a reasonable time, compared to the right to liberty and security in the European Convention of Human Rights. The purpose of the thesis is to examine the Swedish rules regarding pre-trial detention and how they relate to the European Convention and the case law of the European Court of Human Rights, especially whether they can be said to be incompatible.
The first part of the thesis is comprised of an account of the Swedish rules on the prerequisites of pre-trial detention and the right to trial. As the system for pre-trial detention in Sweden lacks a maximum limit for the time that can be spent in detention, the rules rely on frequent retrials, normally every fourteenth day, to protect the individual from arbitrary detention. The thesis also deals with the four available reasons for pre-trial detention established in Swedish law, along with the three established dangers that act as pre-requisites.
The second part of the thesis accounts for the relevant parts of article 5 in the Convention and how the Court has interpreted them in its case law. The different sub-articles of art. 5 are touched upon individually with a strong focus on the reasons for pre-trial detention found in art. 5.1c and the right to trial in art. 5.3.
Finally, after examining a few selected cases from the Court, the Swedish laws are analysed in relation to the Convention in order to identify and describe the flaws that can be found within the Swedish legal system for pre-trial detention. (Less)
