- Föreliggande uppsats utreder uppsåtsbegreppet i svensk straffrätt. Den avser
att undersöka de ontologiska och epistemologiska aspekterna av
uppsåtsbegreppet i ljuset av Ludwig Wittgensteins senare filosofi. Syftet är
att visa på hur uppsåtet har antagits existera, och vilka konsekvener som kan
dras utifrån dessa antaganden. I synnerhet handlar det om hur de påverkar
inställningen till frågor om bevisning av uppsåt.
Några centrala teman i den svenska doktrinen om uppsåt undersöks, och en
underliggande motsättning visas mellan synen på uppsåtet som ett mentalt
tillstånd och uppsåtet som en intrinsikal del av handlandet i sig. Vidare
undersöks några fall ur praxis för att visa på den skillnad som föreligger

I ljuset av den teoretiska bakgrunden som utgörs av framförallt den senare
Wittgensteins språkfilosofi hävdas att uppsåt inte kan förstås som ett
mentalt tillstånd. Istället föreslås en syn på uppsåt som ett komplext begrepp
som förutsätter värdering och tolkning av handlingar. Vidare hävdas att
uppsåt inte kan ses som en ren sakfråga, utan att uppsåtsbegreppet
överskrider distinktionen mellan rättsfrågor och sakfrågor och inbegriper
både rättslig värdering och faktafrågor.
Den traditionella problematiken kring uppsåt omformuleras således som en
fråga om värdering och tolkning av handlingar. Genom den distinktion
mellan regelföljande och tolkning som hämtas från Wittgenstein kan
skillnaden mellan de klara och de oklara fallen av uppsåt förstås. Den
specifika problematik kring uppsåt som uppstår i de oklara fallen kan då
formuleras som en tolkningsproblematik, i motsats till en bevisproblematik. (Less) - Abstract
- This essay examines the concept of dolus in Swedish criminal law. It
purports to examine the ontological and epistemological aspects of the
notion in light of the philosophy of language of the later Ludwig
Wittgenstein. The purpose is to show what consequences can be drawn from
the assumptions made about the nature of the notion of dolus. Specifically,
what is examined is the impact these assumptions have on how the method
of proving dolus is conceived.
Some central strands of the doctrine of dolus in Swedish legal science are
examined, showing an underlying conflict between the understanding of
dolus as a mental state and the view that dolus is a trait of the inherent
meaningfulness of actions. Furthermore some relevant cases... (More) - This essay examines the concept of dolus in Swedish criminal law. It

attempting to differentiate between the clear cases of dolus and the
ambigous.
Through the theoretical framework of the philosophy of language primarily
represented by the later Wittgenstein, the view of dolus as a mental state is
shown to be untenable. It is proposed instead that dolus can be understood
as a complex notion requiring evaluation and interpretation of acts.
Furthermore, it is suggested that dolus cannot be understood as a matter of
fact, but that it transcends the distinction of fact and law, involving both
legal appraisal and fact finding.
The traditional problems of proving dolus is thereupon reformulated as a
problem of evaluation and interpretation of acts. Through the difference
between rule-following and interpretation suggested by Wittgenstein, the
difference between the clear and the ambigous cases of dolus can be
understood. The specific problem relating to dolus which occurs in the
ambigous cases is then formulated as a problem of interpretation, as
opposed to a problem of proof. (Less)
