- Införandet av en friköpsrätt för jordbrukare som lever på historiska arrenden har i Sverige diskuterats under lång tid, men ännu finns ingen lag. Den främsta anledningen är att ett införande befarats stå i strid med Sveriges åtaganden enligt art. 1 i första tilläggsprotokollet till EKMR. Uppsatsen avser att ur ett kritiskt och historiskt perspektiv utreda om denna farhåga är berättigad och om så inte är fallet vad är då den egentliga anledningen till att en lag inte införts?
Som svar på ovan ställda frågor har följande konstaterats; införandet av en friköpslag är förenligt med EKMR:s bestämmelser om egendomsskydd. Således är påståendet att en friköpslag skulle strida mot Europakonventionen felaktigt. Frånvaron av en lag bör istället... Denna ovilja går i sin tur att härleda till stora intresseorganisationers motstånd mot ett införande och att de berörda arrendatorerna haft en svag position i samhället. Den historiska bakgrunden till friköpsfrågan är alltså av avgörande betydelse för frånvaron av en friköpslag för historiska arrenden. (Less) - Abstract
- The introduction of a law prescribing a right to freehold for tenants living on historical leases has been discussed for a long time in Sweden, but as of yet no such law exists. The main reason is that an introduction was feared to be in conflict with Sweden's commitments under Art. 1 of the First Protocol to the ECHR. The essay aims, from a critical and historical perspective, to investigate whether this concern is justified. If not what is the actual reason why a law has not yet been implemented?
In response to the above questions the following conclusions have been made: the introduction of the leasehold reform is compatible with the ECHR concerning the protection of property. The absence of a law should instead be explained by a lack... (More) - The introduction of a law prescribing a right to freehold for tenants living on historical leases has been discussed for a long time in Sweden, but as of yet no such law exists. The main reason is that an introduction was feared to be in conflict with Sweden's commitments under Art. 1 of the First Protocol to the ECHR. The essay aims, from a critical and historical perspective, to investigate whether this concern is justified. If not what is the actual reason why a law has not yet been implemented?

This reluctance can be traced back to large interest groups resisting the introduction and that the affected tenants have had a weak position in society.
