- I denna uppsats behandlas rätten till att bruka vapen vid nödvärn och nödvärnsexcess ur ett rättssäkerhetsperspektiv. Rätten till nödvärn och nödvärnsexcess stadgas i 24 kap 1 § respektive 24 kap 6 § brottsbalken.
Rätt till nödvärn föreligger bl.a. när någon blir utsatt för ett angrepp på person, såvida den angripne inte går utöver vad som får anses vara uppenbart oförsvarligt.
Bedömningen görs objektivt och gärningen betraktas inte som brottslig om nödvärn föreligger. Skulle våldet gå utöver vad som är uppenbart oförsvarligt finns en möjlighet att bli ursäktad enligt nödvärnsexcess om den försvarshandlande svårligen kunnat besinna sig. Via ett antal rättsfall från såväl Högsta domstolen som underinstanser, där bruk av vapen är karaktäristiskt, försöker jag belysa bedömningsproblematiken. Det ställs höga krav på att den angripna personen först väljer alternativa handlingsmöjligheter. Enligt min uppfattning korrelerar det dåligt med den praxis som behandlar individens rätt att i princip stanna och försvara sig istället för att fly.
Beväpning som sådan betyder dock inte att man automatiskt givit upp sin nödvärnsrätt. Utan flera rättsfall tar sikte på hur vapnet brukats.
Min uppfattning är dock att stora krav ställs på att den nödvärnshandlande agerat på ett korrekt sätt i en svår situation, där alltför liten hänsyn tas till vad som kunnat ske om denne inte agerat på det sätt som gjorts. (Less) - Abstract
- This paper analyses the right to use weapons in self-defence and excessive self-defence from a legal perspective.
The right of self-defence and excessive self-defence is stated in Chapter 24 section 1 and Chapter 24 section 6 in Brottsbalken (the Swedish penal code). The right of self-defence is inter alia granted people who are subject to an attack unless the self-defence is unreasonably. The judgement is objective and the act is not considered a crime if it's done under self-defence. If the violence goes beyond what is obviously unjustifiable there is an opportunity to be excused under excessive self-defence actions, when the acting person hardly could come to his senses.

Excessive self-defence is a so-called dependent crime taken into account if someone has gone beyond the defences contained in the 24th chapter Brottsbalken (Swedish penal code), the action is still considered to be a crime. Through a number of cases from the courts, where the use of weapons is characteristic, I try to highlight the evaluation problem. The law requires that the affected person first choose an alternative way of action. This correlates badly with the customary, which has basically given the individual a right to stay and defend himself instead of escaping.
However, the armament as such does not imply that the attacked person has given up his right of self-defence. Instead, a number of cases focus on how the weapons were used.
In my opinion, there are high requirements that the self-defence action is acted in a correct manner in a complicated situation. I think too little is taken to account of what could have happened if the attacked person didn’t act the way he did. (Less)
