- Intelligence sharing between states is becoming increasingly frequent as new terror attacks occur. The information traditionally shared has been warnings concerning more or less specific persons and threats. In the present day, the information shared tends to be personal data which is transferred in bulk. There is no clear suspicion as to crimes committed by the persons whose data is transferred. The information is processed in data-mining programs to find people who statistically are prone to commit attacks. The information traditionally shared has been warnings concerning more or less specific persons and threats. In the present day, the information shared tends to be personal data which is transferred in bulk. There is no clear suspicion as to crimes committed by the persons whose data is transferred. The information is processed in data-mining programs to find people who statistically are prone to commit attacks. It is unclear as to what happens with the right of personal data protection in these intelligence sharing networks or which state is responsible for enforcing the respect of Human Rights. One of the most well-known intelligence sharing agreements of personal data is between the EU and the USA. The aim of this research paper is to establish what legal rights exist for the individuals whose personal data is processed in the previously mentioned intelligence sharing network. This will be done by analyzing where in EU and US legislation the right of personal data protection can be found, how said data protection is conceptualized and who it is applicable to. In this research paper a comparative methodology will be paired with a case-study approach to ascertain which rights to personal data protection exist in the EU and the US. (Less)
