- Förekomsten av ett formulerat beviskrav, tillämpligt på EU:s konkurrensprocess, har debatterats flitigt och med emfas. Denna uppsats studerar EU-domstolarnas rättsfall och fastslår att det går att utläsa att det finns ett tillämpat beviskrav, även om detta beviskrav fortfarande är under utveckling och inte till fullo är formulerat. Vidare analyseras detta beviskrav mot bakgrund av EU kommissionens breda kompetens att fastställa företags konkurrensrättsbrott, samt därpå följande böter och åtgärder, genom utfärdandet av beslut. Konkurrensrättsbrottets kategorisering, så som varande antingen en administrativ eller straffrättslig process, beskrivs och diskuteras i relation till begränsningarna i EU-domstolarnas jurisdiktion inom området.... Vidare analyseras detta beviskrav mot bakgrund av EU kommissionens breda kompetens att fastställa företags konkurrensrättsbrott, samt därpå följande böter och åtgärder, genom utfärdandet av beslut. Avslutningsvis diskuteras hur området skulle påverkas av införandet av ett tydligt applicerbart beviskrav. Slutligen dras slutsatsen att ett beviskrav redan är under utveckling och tillämpas, samt att detta är eftersträvansvärt givet utvecklingen av de grundläggande rättigheterna efter Lissabonfördraget. - The existence of a standard of proof in regards of the European Union competition infringement process has been hotly debated. This thesis reviews the Court of Justice of the European Union's case law on the subject and concludes that it can be distinguished that there is a standard of proof in application, although this standard is still in its early developing stages. The impact of this standard is examined on the background of the broad discretion that the European Commission possess to issue decisions establishing the infringements of undertakings, and the possible fines, penalties and remedies that follow. This thesis reviews the Court of Justice of the European Union's case law on the subject and concludes that it can be distinguished that there is a standard of proof in application, although this standard is still in its early developing stages. The impact of this standard is examined on the background of the broad discretion that the European Commission possess to issue decisions establishing the infringements of undertakings, and the possible fines, penalties and remedies that follow. The nature of the competition infringement process, administrative or criminal, in combination with the limits of the CJEU’s grounds for review of Commission’s decisions is described and put into context in regards of fundamental rights, and how this could be affected by the clear establishment of an EU specific standard of proof. It is concluded that a standard of proof is not only already in application and development, it is also desirable in the light of the increased fundamental rights, and demands for due process, after the Treaty of Lisbon.
