Kommuners ansvar för våldsutsatta kvinnor med tillfälligt uppehållstillstånd

Årligen beviljas ett stort antal tillfälliga uppehållstillstånd till kvinnor pga. anknytning. Par som inte har bott tillsammans stadigvarande blir beviljade ett tidsbegränsat uppehållstillstånd med en prövotid på två år. Om förhållandet består efter de två åren får ett permanent uppehållstillstånd beviljas. För det fall att förhållandet skulle ha upphört pga. våld eller annan allvarlig kränkning finns det möjlighet för utlänningen att ett uppehållstillstånd ändå kan beviljas enligt den s.k. skyddsregeln.

För att omfattas av skyddsregeln efter våld i förhållandet uppställs vissa kriterier som i praktiken har visat sig svåra att uppnå, vilket har gjort att skyddsregeln har fått utstå en hel del kritik. Chansen för kvinnan att få stanna kvar om förhållandet har avslutats innan de två åren har passerat är därför mindre än om kvinnan stannar kvar i förhållandet, vilket leder till att kvinnan är i en beroendeställning till mannen. Kvinnor med tillfälligt uppehållstillstånd som utsätts för våld i relationen har två val; antingen väljer de att lämna sitt förhållande med förhoppning om att de ”kvalificerar in” under skyddsregeln eller så väljer de, av rädsla för att bli utvisade, att stanna kvar i förhållandet och utstå våld tills de två prövoåren har passerat.

Våldsutsatta kvinnor med tillfälligt uppehållstillstånd anses vara dubbelt utsatta pga. att de dels är utsatta för våld, dels har ett tillfälligt uppehållstillstånd. Det tillfälliga uppehållstillståndet gör att kvinnan blir beroende av mannen eftersom hon riskerar att utvisas från Sverige om inte kraven i skyddsregeln uppfylls, vilket gör det extra svårt att bryta sig loss ur förhållandet. Vidare anses våldsutsatta kvinnor med tillfälligt uppehållstillstånd vara en särskilt sårbar grupp eftersom de t.ex. ofta är socialt isolerade, har bristande språkkunskaper och dålig kännedom om det svenska samhället och deras rättigheter.

Det är socialtjänsten som har det yttersta ansvaret för att de personer som befinner sig inom kommunens geografiska område får den hjälp och det stöd som de behöver. Socialtjänstens ansvar för våldsutsatta kvinnor tydliggörs i 5 kap. 11 § 2 st. SoL. Insatserna till dessa kvinnor kan variera då de måste anpassas till omständigheterna i det enskilda fallet. Det kan t.ex. handla om hjälp- och stödinsatser i form av ekonomiskt bistånd, hjälp med att ordna skyddat boende samt råd och hjälp med praktiska saker.

Uppsatsens syfte har varit att redogöra för och analysera primärkommuners skyldigheter och möjligheter att hjälpa våldsutsatta kvinnor i anknytningsrelationer med tillfälligt uppehållstillstånd. Slutsatsen är att skyddsregeln utgör det största hindret för att kunna tillgodose dessa kvinnors hjälpbehov till fullo. Följaktligen bör bestämmelsen ändras så att ett förstärkt skydd till kvinnorna ges; det skulle underlätta och förbättra socialtjänstens arbete med våldsutsatta kvinnor med tillfälligt uppehållstillstånd. Yearly a large number of residence permit with limited duration is granted to women who immigrated to Sweden through attachment relationships. Couples who have not been cohabitants will be granted a residence permit with limited duration with a two-year probationary period. If the relationship contains after the two-year time limit has expired, a residence permit can be granted. Even if the relationship has ended before the two-year probationary period has expired, a residence permit may be granted if the main reason for ending the relationship is that the woman have been exposed to violence or other serious violations of freedom or personal integrity (the domestic violence rule).

Even though there is a possibility for the abused women to be granted a residence permit, it has been shown that the criteria in the domestic violence rule is difficult to obtain, which has made the immigration law to endure criticism. The chance for the woman to stay in Sweden if the relationship has ended before the two-year probationary period has expired is less than if the woman decides to stay in the relationship. Therefore the woman is in a position of dependence of the man. Women who are granted residence permit with limited duration and are exposed to violence have two alternatives; either they choose to leave their relationship with hope that they will “qualify” under the domestic violence rule or they will choose, due to fear of deportation, to continue their relationship in which they are abused until the two-year time limit has expired.

Abused women who are granted residence permit with limited duration are doubly vulnerable due to they are partly exposed to violence, partly have a residence permit with limited duration. Because of the residence permit with limited duration the woman is in a position of dependence of the man since she risks being deported from Sweden if the criteria in the domestic violence rule are not met, which makes it extra difficult to end the relationship. Furthermore, abused women who are granted residence permit with limited duration are particularly vulnerable since they often are socially isolated, have insufficient linguistic knowledge and very little awareness of the Swedish society and their rights.

The social welfare system has the ultimate responsibility to make sure that the people who are within the municipal geographic area receive the aid and support they need. The social welfare system has the responsibility of abused women and it is clarified in 5 chapter 11 § 2 paragraph SoL. The efforts for these women can vary, as they must adapt the effort to the circumstances of the individual case. The aid and support may e.g. measures in the form of financial assistant, assistant in arranging sheltered accommodation and aid with practical things.

The main purpose of this thesis has been to describe and to analyse primary municipality obligations and opportunities to help abused women who is granted resident permit with limited duration. I have reached the conclusion that the domestic violence rule is the major obstacle to meet these women’s need for assistance. Consequently, there must be a change of the immigration law in order to improve the shelter for the immigrated women in attached relationships; for the social welfare system, it would facilitate and improve their work with these abused women.
