Religion eller tradition? – en undersökning av gränsdragningen mellan tradition och religion vid anordnandet av skolavslutningar i Svenska kyrkans lokaler

I vårt mångkulturella samhälle tilldelas religionsfriheten stor betydelse. En fråga som förefaller aktuell inom detta område är huruvida skolavslutningar får anordnas i kyrkan eller inte. Ett flertal intressen kan bli aktuella när frågan behandlas och en avvägning mellan dessa måste ske. Tänkvärda aspekter att se till är förhållandet mellan religion och tradition samt intresseavvägningen mellan dels barn och föräldrar, dels skola och familj.

Den aktuella regleringen angående religionsfrihet återfinns i EKMR och regeringsformen. En diskussion angående överensstämmelsen mellan bestämmelserna samt tillämpningen av dem är av intresse. Ett flertal intressen kan bli aktuella när frågan behandlas och en avvägning mellan dessa måste ske. Tänkvärda aspekter att se till är förhållandet mellan religion och tradition samt intresseavvägningen mellan dels barn och föräldrar, dels skola och familj.

Den aktuella regleringen angående religionsfrihet återfinns i EKMR och regeringsformen. En diskussion angående överensstämmelsen mellan bestämmelserna samt tillämpningen av dem är av intresse. Bestämmelserna om religionsfriheten om¬fattar en rätt till religion men även en rätt från religion. De omfattar även en rätt att uttrycka sin religion. Utöver det omfattar EKMR även viss rätt att påverka andra. I förhållandet mellan religion och utbildning innebär EKMR därutöver en viss skyldighet för skolan att respektera föräldrarnas trosuppfattningar.

Ett flertal rättsfall har behandlat avvägningen mellan religion och utbildning. Exempel på ämnen som har behandlats är förekomsten av religiösa symboler i klassrum samt föräldrars rätt att få sin tro respekterad. Ett antal myndighetsbeslut har även fattats angående frågan om det är tillåtet att anordna skolavslutningar i kyrkan. Resultaten av avgörandena kan sammanfattas genom att betona vikten av staters neutralitet. Även mångfald, tradition, respekt och staters individuella bedömnings¬marginal har tilldelats stor betydelse.

Ett viktigt perspektiv att ha i åtanke när frågan om skolavslutningar diskuteras är barnets perspektiv. Anledningen är att barnet kan komma i en situation där både skolans och familjens intressen påverkar barnet. Ytterligare ett perspektiv är föräldrarnas, detta då föräldrarna har det primära ansvaret för sina barns uppfostran. Bedömningen av vad som uppfattas som tradition är också viktig. Troligtvis kan inget entydigt svar ges på frågan om skol¬avslutningar alltid bör vara tillåtna i kyrkan utan en avvägning får ske utifrån förutsättningarna i det enskilda fallet. (Less)

Freedom of religion is a democratic value of great importance in our multicultural society. A question that is perceived to be important within this subject is whether or not graduation ceremonies are allowed to be held in churches. A number of interests may be of importance when this question is discussed and a levelling between the different interests is not uncommon. Important factors to look at are the relationship between religion and tradition as well as the weighing of interests between child and parent, school and family.

The regulation of freedom of religion is found in the ECHR and “the Instrument of Government”. A discussion about the conformity between the regulations as well as the application is of interest. The... (More)
Freedom of religion is a democratic value of great importance in our multicultural society. A question that is perceived to be important within this subject is whether or not graduation ceremonies are allowed to be held in churches. A number of interests may be of importance when this question is discussed and a levelling between the different interests is not uncommon. Important factors to look at are the relationship between religion and tradition as well as the weighing of interests between child and parent, school and family.

The regulation of freedom of religion is found in the ECHR and “the Instrument of Government”. A discussion about the conformity between the regulations as well as the application is of interest. The regulation embraces a right to religion as well as a right from religion. It also embraces a right to manifest your religion. Moreover, the ECHR embraces a right to influence others. In regards to the relationship between religion and education, ECHR also oblige the school to respect the parents’ beliefs.

A number of cases have reached the court and the balance between religion and education has been discussed. Religious symbols in classrooms and parents’ right to have their beliefs respected are examples. A number of official decisions have also been made regarding the question about graduation ceremonies. The results of the decisions can be summarized by accentuating the neutrality of the states. Multiplicity, tradition, respect and the states’ margin of appreciation have also been of importance.

An important perspective to consider is the perspective of the child. The reason is that a child can be affected by both the school’s and the families’ interests. Another perspective is the parents’, this is because the parents’ have the primal responsibility for the child’s rearing. The classification of what is seen as tradition is also of importance. There is most likely no univocal answer to the question of whether a graduation ceremony always should be permitted in the church. An evaluation has to be made from the conditions in the particular case. (Less)
