- Framställningen behandlar de rättsliga förutsättningarna och rättstillämpningen beträffande anhållning och häktning av personer i åldern 15-17 år, med fokus på rättssäkerheten i dessa förfaranden. Vidare kartläggs och diskuteras den återkommande kritik som riktats mot Sveriges anhållningar och häktningar. Anhållning och häktning regleras i lag, främst i 24 kap. rättegångsbalken, men även i specialbestämmelser som enbart gäller för unga eftersom extra restriktivitet krävs för att anhålla och häkta personer under 18 år. För anhållning, häktning och restriktioner krävs alltid en avvägning om den frihetsberövade personens lidande uppvägs av skälen för ingripandet samt att rekvisiten i övrigt uppfylls. Vidare kartläggs och diskuteras den återkommande kritik som riktats mot Sveriges anhållningar och häktningar. Anhållning och häktning regleras i lag, främst i 24 kap. rättegångsbalken, men även i specialbestämmelser som enbart gäller för unga eftersom extra restriktivitet krävs för att anhålla och häkta personer under 18 år. För anhållning, häktning och restriktioner krävs alltid en avvägning om den frihetsberövade personens lidande uppvägs av skälen för ingripandet samt att rekvisiten i övrigt uppfylls. I praktiken varierar motiven som åklagare och domstolar anger i anhållnings- och häktningsbeslut. Dock är det relativt vanligt att det inte förs något individualiserande resonemang överhuvudtaget, vilket inte alltid heller är ett krav i lagbestämmelserna. Emellertid kan det faktum att rätten inte motiverar sina häktningsbeslut innebära att Sverige bryter mot Europakonventionen.
Sveriges anhållningar och häktningar har kritiserats från både nationellt och internationellt håll under lång tid. Anmärkningar har gjorts på allt från bristande motivering från domstolar till barnens tillvaro i arrest och häkte. Kritiken tyder på att det ofta saknas ett barnperspektiv i förfarandena. Vidare kan kritiken kopplas till rättssäkerhet, eftersom fler av omständigheterna som kritiserats medför brister i densamma. Exempelvis orsakar otydliga lagregleringar brister i förutsebarheten av besluten och vidare kan de nuvarande förhållandena på arrester och häkten innebära att unga personer inte får möjlighet att förbereda sitt försvar. Slutsatsen blir därmed att det finns fog för mycket av kritiken och att det finns rättssäkerhetsbrister i anhållnings- och häktningsbeslut samt överlag i dessa förfaranden. Resultaten visar att det krävs en reform beträffande regleringen av anhållning och häktning av unga i Sverige, för att åstadkomma en förbättring av rättssäkerheten och uppnå internationella krav. - This graduate thesis examines the legal conditions and the application of the law concerning arrest and pre-trial detention of juveniles aged 15 to 17 years, with the main focus upon the principle of legal security in these proceedings. Furthermore, the thesis investigates the reoccurring criticism of Swedish arrests and pre-trial detentions. Arrest and pre-trial detention are regulated in the code of judicial procedure, in chapter 24. There are also special rules regarding juveniles, since it requires an extra restrictiveness to arrest and detain people under 18 years of age. - This graduate thesis examines the legal conditions and the application of the law concerning arrest and pre-trial detention of juveniles aged 15 to 17 years, with the main focus upon the principle of legal security in these proceedings. Furthermore, the thesis investigates the reoccurring criticism of Swedish arrests and pre-trial detentions. Arrest and pre-trial detention are regulated in the code of judicial procedure, in chapter 24. There are also special rules regarding juveniles, since it requires an extra restrictiveness to arrest and detain people under 18 years of age. To justify arrest, pre-trial detention and restrictions, the suspect’s suffering must be proportionally to the reasons for the intervention. In practice, the grounds for the decisions diverge between different cases, though it is relatively common that the decisions are not clarified at all. The domestic law does not always require such a motivation. However, the fact that the courts do not always justify their grounds for decision regarding the detention orders implies that the provisions of the European Convention on Human Rights are violated.
The Swedish arrests and pre-trial detentions have regularly been severely criticised, in several areas, during a long period of time. For instance, there have been remarks concerning the grounds for the decisions and the juveniles’ living conditions in arrest and pre-trial detention. Furthermore, the criticism indicates that there is an absence of a child perspective in the proceedings. The criticism can also be connected to legal security, since the juveniles are not given an adequate possibility to prepare their defence. This is mainly due to the present conditions during arrest and pre-trial detention. In conclusion, most of the criticism is justified and the legal security in Sweden has shortcomings in theses specific areas. The results of the thesis suggest that an amendment of law is warranted concerning Swedish arrest and detention procedures of juveniles. Then, international standards and an improvement of legal security might be obtained. (Less)
