- Rätten till nödvärn är en av de ansvarsfrihetsgrunder som rättfärdigar en annars brottsbelagd gärning. För att nödvärn ska föreligga måste nödvärnshandlingen inte vara uppenbart oförsvarlig samt och det måste föreligga en nödvärnssituation. I denna försvarlighetsbedömning granskas angreppets beskaffenhet, det angripnas betydelse och omständigheterna i övrigt. Andra faktorer som kan påverka bedömningen av nödvärn är förekomsten av en putativt nödvärnssituation eller om personen i fråga svårligen kunnat besinna sig, det vill säga använt nödvärnsexcess. I denna försvarlighetsbedömning granskas angreppets beskaffenhet, det angripnas betydelse och omständigheterna i övrigt. Andra faktorer som kan påverka bedömningen av nödvärn är förekomsten av en putativt nödvärnssituation eller om personen i fråga svårligen kunnat besinna sig, det vill säga använt nödvärnsexcess. I detta arbete utreds olika föreställningar som finns i samhället och rättsväsendet kring brottsoffer och gärningspersoner och om dessa föreställningar kan återfinnas i domstolarnas bedömning av nödvärnsrätten, med särskilt fokus på försvarlighetsbedömningen. De samhällsgrupper som ofta brukar anses vara ideala brottsoffer är kvinnor, barn och särskilt utsatta minoriteter. Dessa grupper brukar endast betraktas som brottsoffer om de uppfyller de krav och innehar typiska egenskaper som ett idealt brottsoffer har. Kvinnor som stannar kvar i våldsamma relationer brukar till exempel inte betraktas som klassiska brottsoffer eftersom de kunde ha undvikt det fortsatta våldet. Män, ungdomar och de kriminellt belastade betraktas av samhället och rättsväsendet som ideala gärningspersoner. I uppsatsen har tio rättsfall med hjälp av en diskursanalytisk metod granskats för att utreda om föreställningar kring dessa grupper kan återfinnas i domstolarnas försvarlighetsbedömning, eller nödvärnsbedömning. En bedömning har bland annat gjorts av domstolarnas formuleringar kring den tilltalade eller målsägande, vad som domstolen underlåtit att medta i sin bedömning av nödvärnsrätten och vad som domstolen väljer att framhäva i sina domskäl. Resultatet visade att vissa föreställningar eller diskurser kring brottsoffer och gärningspersoner kunde återfinnas i försvarlighetsbedömningen eller andra nödvärnsbedömningar. Dessa kunde till exempel bestå av ett onödigt utpekande av den tilltalades kön eller tidigare kriminella förflutna eller en underlåtenhet att nämna tidigare misshandel eller andra brottsliga handlingar som den tilltalade utsatts för av målsägande. Värt att notera är att vissa av dessa föreställningar skulle kunna falla under försvarlighetsbedömningen eller annan nödvärnsbedömning som hanterades i domskälen. Sammanfattningsvis tyder resultatet på att domstolar till viss del är subjektiva vid bedömningen av nödvärnsrätten och att de beaktar och tillämpar föreställningar kring ideala gärningspersoner och brottsoffer för att avgöra vem som har rätt att försvara sig. - The right to self-defence is one of the few ways to render an otherwise illegal action legal. The right to self-defence can only be given if the action taken by the attacked was not clearly unjustifiable and the situation calls for self-defence, according to the situations given in first paragraph in the 24 chapter of the Swedish Penal Code. In the assessment of whether or not the act is clearly unjustifiable the nature of the aggression, the importance of its object and the circumstances in general must be taken into account. Factors such as putative self-defence and excessive self-defence can also impact the assessment of the right to use self-defence. - The right to self-defence is one of the few ways to render an otherwise illegal action legal. The right to self-defence can only be given if the action taken by the attacked was not clearly unjustifiable and the situation calls for self-defence, according to the situations given in first paragraph in the 24 chapter of the Swedish Penal Code. In the assessment of whether or not the act is clearly unjustifiable the nature of the aggression, the importance of its object and the circumstances in general must be taken into account. Factors such as putative self-defence and excessive self-defence can also impact the assessment of the right to use self-defence. The objective of this essay is to examine if perceptions exist in our society and judicial system about victims of crime and about perpetrators and if these perceptions can be found in the courts judgements regarding the right to self-defence, especially in the reasoning surrounding whether the act was justifiable. Women, children and minorities are usually considered ideal victims of crime. However, they are only considered ideal victims as long as they show the same redeeming qualities as an ideal victim of crime. A women is for instance not considered an ideal victim if she chooses to stay in a violent relationship, as she could avoid further mistreatments by leaving the perpetrator. Men, youths and those with a criminal background are normally considered to be ideal perpetrators. In this essay, ten cases have been studied, using discourse analysis as a method, to investigate if these perceptions can be found in the courts judgements regarding the right to self-defence. The analysis have factored in formulations used by the courts regarding the defendant or the injured party, circumstances the courts have not mentioned in their judgement and what factors the court seems to highlight in their decisions. The result of the analysis showed that some perceptions regarding the perpetrator and the victim could be found in the court’s judgement about self-defense. There are cases where perceptions could be shown to influence the court. Irrelevant formulations or descriptions of the sex, age or criminal past of the defendant or injured party are used to justify the ruling or the court fails to draw on important circumstances such as previous assaults when evaluating whether or not the defendant had a right to self-defence. What should be noted is that some of the perceptions found in the judgements could be considered to be necessary factors in the courts judgements. Nevertheless, the result indicates that the courts sometimes are subjective when assessing the right to self-defence and that they sometimes factor in common perceptions about ideal perpetrators and victims when deciding who has a right to defend themselves.
