The purpose of this thesis is to investigate whether the workers’ rights, enshrined in Title IV of the EU Charter of Fundamental Rights, can be invoked directly in proceedings between private parties, i.e. whether the provisions are capable of having horizontal direct effect. The entitlement of workers to annual paid leave under article 31(2) of the Charter can be mentioned as an example of the rights enshrined in Title IV.

The thesis begins by describing the content and scope of the Charter, and then proceeds to examine various levels of horizontal effect and their differences. The purpose of this thesis is to investigate whether the workers’ rights, enshrined in Title IV of the EU Charter of Fundamental Rights, can be invoked directly in proceedings between private parties, i.e. whether the provisions are capable of having horizontal direct effect. The entitlement of workers to annual paid leave under article 31(2) of the Charter can be mentioned as an example of the rights enshrined in Title IV.

The thesis begins by describing the content and scope of the Charter, and then proceeds to examine various levels of horizontal effect and their differences. It then focuses on the provisions of the Charter and their potential horizontal direct effect. In this regard, the case law of the European Court of Justice is carefully studied.

With the Court’s case law and the wording of the articles in mind, it is concluded that most of the provisions in Title IV of the Charter probably are incapable of being applied directly in horizontal disputes. The thesis then tries to answer whether this position reflects a reasonable balance between the competing interests which are at stake.

It is argued that the Court’s restrictive approach towards the horizontality of the Charter is justified with regard to legal certainty and the institutional equilibrium within the EU. At the same time, it is acknowledged that the protection of workers’ rights within the scope of private law relationships remains essential in order for the EU to reach its social objectives. Thus, alternative ways of safeguarding those rights are highlighted. (Less)

Syftet med uppsatsen är att utreda om arbetstagare kan åberopa rättigheterna i avdelning IV i EU:s rättighetsstadga direkt gentemot enskilda arbetsgivare, det vill säga om rättigheterna har horisontell direkt effekt. Som exempel på en rättighet i stadgans avdelning IV kan nämnas varje arbetstagares rätt till årlig betald semester i artikel 31.2.

Efter en genomgång av rättighetsstadgans innehåll och tillämpningsområde beskrivs olika nivåer av horisontell effekt och vad som skiljer dem åt. Därefter fokuserar uppsatsen på just rättighetsstadgans bestämmelser och huruvida de har horisontell direkt effekt eller ej. EU-domstolens praxis på området ägnas särskild uppmärksamhet.

Med utgångspunkt i EU-domstolens praxis och artiklarnas utformning, dras slutsatsen att många av bestämmelserna i stadgans avdelning IV troligen inte kan tillämpas direkt i tvister mellan enskilda. Här uppkommer då frågan om rättsläget återspeglar en rimlig balans mellan de olika intressen som står mot varandra.

Hänsyn till rättssäkerheten för enskilda och den institutionella jämvikten inom EU, motiverar och rättfärdigar enligt uppsatsen EU-domstolens restriktiva inställning till rättighetsstadgans horisontella effekt. Samtidigt konstateras att det är av stor vikt att grundläggande rättigheter upprätthålls också i privaträttsliga sammanhang för att EU ska uppnå sina sociala målsättningar. I den mån horisontell direkt effekt inte anses lämplig, påminns därför om andra möjliga vägar för att ge grundläggande rättigheter verkan i det rättsliga förhållandet mellan enskilda. (Less)
