Syftet med denna uppsats är att undersöka om faderskapspresumtionen spelat ut sin roll och huruvida den är förenlig med barnets bästa. Faderskapspresumtionen är känd redan från den romerska rätten och innebär att när en gift kvinna får barn antas hennes make vara far till barnet. När ett barn föds av en ogift moder måste faderskapet fastställas genom bekräftelse eller dom. Föreliggande uppsats presenterar argument för respektive emot att gifta och ogifta föräldrar behandlas olika när faderskapet ska fastställas.

Syftet med denna uppsats är att undersöka om faderskapspresumtionen spelat ut sin roll och huruvida den är förenlig med barnets bästa. Faderskapspresumtionen är känd redan från den romerska rätten och innebär att när en gift kvinna får barn antas hennes make vara far till barnet. När ett barn föds av en ogift moder måste faderskapet fastställas genom bekräftelse eller dom. Föreliggande uppsats presenterar argument för respektive emot att gifta och ogifta föräldrar behandlas olika när faderskapet ska fastställas.

Barnets bästa är en princip som präglar hela den svenska familjerättslagstiftningen och uppsatsen behandlar barnets bästa i förhållande till faderskapet. Av uppsatsens slutsatser framgår att barnets intresse har beaktats vid utformningen av reglerna för fastställande av faderskap men att det är svårt att säga huruvida just faderskapspresumtionen är förenlig med principen om barnets bästa. I takt med DNA-teknikens utveckling synes det mer viktigt nu än förr att det rättsliga faderskapet överensstämmer med det biologiska, men eftersom det inte gjorts någon tillförlitlig undersökning av hur ofta mannen i äktenskapet inte är biologisk far till barn som föds av gift moder är det svårt att veta hur ofta presumtionsregeln inte leder till överensstämmelse mellan rättsligt och biologiskt faderskap.

Vidare har kunnat konstateras att samlevnadsformerna har förändrats över tiden och i Sverige föds majoriteten av barnen av en ogift moder. Mot bakgrund av detta har jag kunnat dra slutsatsen att faderskapspresumtionen får anses ha fått en mindre praktisk betydelse. Förslaget att slopa presumtionsregeln har dock avfärdats med hänvisning till det betydande merarbete som det skulle innebära för myndigheter och enskilda att fastställa faderskapet på annan väg. Att ge ett konkret svar på frågan om faderskapspresumtionen har spelat ut sin roll visade sig vara svårt då det är många faktorer som måste beaktas. (Less)
Abstract
The purpose of this essay is to investigate if the presumption of legitimacy has had its day and if it is compatible with the child’s best interest. The presumption of legitimacy is known all the way back from Roman law and means that the husband of a women is pressumed to be the father to the child to whom she gives birth. When a unmarried woman gives birth to a child, the paternity is established by acknowledgement or judgment. This essay presents arguments for and against married and unmarried couples being treated differently when the paternity is being established.

The purpose of this essay is to investigate if the presumption of legitimacy has had its day and if it is compatible with the child’s best interest. The presumption of legitimacy is known all the way back from Roman law and means that the husband of a women is pressumed to be the father to the child to whom she gives birth. When a unmarried woman gives birth to a child, the paternity is established by acknowledgement or judgment. This essay presents arguments for and against married and unmarried couples being treated differently when the paternity is being established.

The child’s best interest is a principle which characterizes the entire family law in Sweden and the essay discusses the child’s interest in relation to paternity. The conclusions of the essay indicate that the child’s best interest has been taken into account when the rules regarding establishment of paternity were drawn up, but it is difficult to tell whether the presumption of legitimacy specifically is compatible with the principle of the best interests of the child. As DNA technology developments, it seems more important now than ever that the legal paternity is consistent with the biological, but since there has been no reliable study of how often the husband is not the biological father of a child born within the subsistence of a marriage, it is difficult to know how often the presumption does not lead to consistency between legal and biological paternity.

Further has been proven that the relationship forms have changed over time and the majority of children in Sweden are born by an unmarried mother. Against this background, I have been able to conclude that the presumption of the legitimacy may has received a less practical significance. The proposal to abolish the presumption, however, has been dismissed because of the considerable extra work it would create for authorities and individuals to establish paternity in another way. To give a concrete answer to the question if the presumption of legitimacy has had its day proved to be difficult as there are many factors that must be considered. (Less)
