Uppsatsen behandlar frågan om det i svensk rätt finns ett humanitärt undantag från straffbarheten vid människosmuggling och organiserande av människosmuggling. Att något sådant undantag skulle finnas stöds inte av bestämmelsernas ordalydelse men däremot av vissa uttalanden i förarbeten och praxis. Det sägs på flera ställen i både förarbeten och praxis att den inte är straffbart att av endast ideella skäl hjälpa en utlänning till Sverige för att utlänningen ska söka asyl här. Att hjälpa en utlänning till Sverige innebär att utlänningen hjälps till en svensk gräns utan att resa in i Sverige. Att något sådant undantag skulle finnas stöds inte av bestämmelsernas ordalydelse men däremot av vissa uttalanden i förarbeten och praxis. Det sägs på flera ställen i både förarbeten och praxis att den inte är straffbart att av endast ideella skäl hjälpa en utlänning till Sverige för att utlänningen ska söka asyl här. Att hjälpa en utlänning till Sverige innebär att utlänningen hjälps till en svensk gräns utan att resa in i Sverige. Detta är bara möjligt vid gränser där det finns gränskontroller eftersom utlänningen annars måste resa in i Sverige för att kunna söka asyl. Efter Sveriges inträde i Schengensamarbetet har alla gränskontroller vid inre gränser tagits bort och det är därför inte längre möjligt att söka asyl vid en inre gräns utan att resa in i Sverige. Vad som sägs i dessa förarbeten är dock fortfarande tillämpligt när en utlänning av endast ideella skäl hjälps till en yttre gräns för att där söka asyl. Det är då inte tal om något humanitärt undantag från straffbarhet, handlingen omfattas inte alls av straffbarheten i bestämmelsen om människosmuggling.

Hjälp till inresa i Sverige över en yttre gräns omfattas dock av straffbarheten och något humanitärt undantag borde här inte vara tillämpligt. Vid inresa i Sverige över en inre gräns eller vid passerande genom Sverige eller ett annat Schengenland kan dock ett humanitärt undantag vara tillämpligt. Detta följer av praxis. Det krävs i sådana fall att handlingen begåtts av endast ideella skäl för att utlänningen skulle söka asyl i landet och att omständigheterna är sådana att utlänningen inte kunde söka asyl i det land där asylansökan skulle ha gjorts enligt Dublinförordningen. Huruvida ett sådant undantag faktiskt finns är dock inte klart. Det är heller inte klart vilka omständigheter som skulle föranleda att utlänningen inte anses kunna söka asyl i det land där asylansökan skulle ha gjorts enligt Dublinförordningen.

Vid organiserande av människosmuggling utesluts ett humanitärt undantag eftersom bestämmelsen förutsätter vinstsyfte och vid medhjälp till organiserande av människosmuggling borde något humanitärt undantag från straffbarhet inte vara tillämpligt, även om bestämmelsen inte förutsätter vinstsyfte hos medhjälparen.

Mot bakgrund av ovanstående kan det finnas situationer då ett humanitärt undantag från straffbarheten skulle kunna vara tillämpligt, i alla fall vid människosmuggling. Det är dock oklart och det är därför av stor vikt att rättsläget klargörs, antingen av Högsta domstolen eller av lagstiftaren. Fram till dess kommer rättsläget att förbli osäkert vilket leder till oförutsebarhet. (Less)
Abstract
In this thesis it is investigated if there, in the Swedish legislation, is a humanitarian exception concerning punishability in human smuggling and organization of human smuggling. That such an exception exists is not supported by the letter of the law but of certain statements in the preparatory work and the case law. It is said in both preparatory work and the case law that it is not punishable to help a foreigner to Sweden by non-profit reasons with the purpose of letting the foreigner seek asylum here. To help a foreigner to Sweden means that the foreigner is helped to a Swedish border without entering Sweden. In this thesis it is investigated if there, in the Swedish legislation, is a humanitarian exception concerning punishability in human smuggling and organization of human smuggling. That such an exception exists is not supported by the letter of the law but of certain statements in the preparatory work and the case law. It is said in both preparatory work and the case law that it is not punishable to help a foreigner to Sweden by non-profit reasons with the purpose of letting the foreigner seek asylum here. To help a foreigner to Sweden means that the foreigner is helped to a Swedish border without entering Sweden. This is only possible at borders where there are border controls since the foreigner otherwise would have to enter Sweden to seek asylum. After Sweden joined the Schengen cooperation, all border controls at internal borders have been removed and it is therefore no longer possible to apply for asylum at an internal border without having to enter Sweden. What is said in these preparatory works are still applicable when a foreigner is helped to an external border to seek asylum. In these cases it is not a question of a humanitarian exception concerning punishability, it is simply not punishable according to the law. To help a foreigner to enter Sweden over an external border is punishable by the law and a humanitarian exception should not be applied.

When a foreigner is helped to enter Sweden or another Schengen country over an internal border or when a foreigner is helped passing through any of these countries a humanitarian exception concerning punishability could be applied. This follows by the case law. It is required in such cases that the act is committed by non-profit reasons with the purpose of letting the foreigner seek asylum here. The circumstances must be such that the foreigner could not seek asylum in the country where the asylum application should have been made under the Dublin Regulation. If there actually is such an exception and when it is supposed to be applied is not clear.

In organization of human smuggling a humanitarian exception can’t be applied since the rule requires profit. In complicity in the crime organization of human smuggling a humanitarian exception from punishability should not be applied.

To sum up, it is desirable that the Swedish High Court or the legislator clarifies the legal state. Until then, the legal position will remain uncertain. (Less)
