- Hållbar utveckling är ledordet inom såväl miljöpolitiken som miljörätten, däri inbegrips bland annat bevarandet av biologisk mångfald. Trots det bedöms Sverige bara nå två av 16 miljökvalitetsmål inom utsatt tid. Inom flera av områdena som rör bevarandet av biologisk mångfald och värdefulla naturmiljöer går utvecklingen dessutom åt fel håll.
Uppsatsen syftar till att utreda hur rätten kan förändras så att fler naturområden kan skyddas. En central del i naturskyddet är de formella områdesskydden, och i synnerhet naturreservaten, varför utredningen kommer att ta sin utgångspunkt i hur lagstiftningen kan förändras så att fler naturreservat kan bildas.

Naturreservat kan inrättas bland annat för att skydda värdefull natur och bevara biologisk mångfald. Reservat kan bildas på mark som ägs av enskild och genom beslutet kan viss typ av markanvändning förbjudas, till exempel avverkandet av en viss skog. När sådana rådighetsinskränkningar meddelas har markägaren rätt till ekonomisk ersättning – under vissa förutsättningar.
I den miljörättsliga litteraturen har under en längre tid argumenterats för att naturskyddslagstiftningen måste förändras, bland annat så att fler naturreservat kan inrättas. I vägen för en lagstiftning där markägare tvingas ta ett större ansvar står äganderätten som kommer till uttryck i både RF och EKMR. Äganderättsskyddet i EKMR synes emellertid inte vara lika långtgående som det i RF. Om den svenska grundlagen ändrades, vilket jag menar är nödvändigt, skulle således mer ingripande naturskyddslagar kunna stiftas utan att EKMR skulle kränkas.
Traditionella juridiska principer har också funnits vara problematiska både när naturskyddslagar ska stiftas och tillämpas. Till synes opolitiska rättigheter till skydd för den enskilde mot det allmännas ingripande försvårar ett effektivt naturskydd. Samhället dessa växte fram i såg dock väldigt annorlunda ut jämfört med dagens. För att naturskyddet ska kunna stärkas är det min mening att dessa principer måste förändras. (Less) - Abstract
- In environmental policy, as well as in environmental law, sustainable development is the keyword. To achieve this, preservation of biodiversity is central. Despite this, Sweden is expected to reach only two out of 16 environ-mental quality goals in time. Furthermore, in a number of areas relating to the preservation of biological diversity and valuable natural environments, development is made in the wrong direction.
The purpose of this thesis is to investigate in what way the law can be al-tered so that more natural areas can be protected. A central element in the protection of nature are formally protected areas, and especially nature reserves, why the investigation initially focuses on the legislation regarding nature reserves.

Furthermore, in a number of areas relating to the preservation of biological diversity and valuable natural environments, development is made in the wrong direction.
The purpose of this thesis is to investigate in what way the law can be al-tered so that more natural areas can be protected. A central element in the protection of nature are formally protected areas, and especially nature reserves, why the investigation initially focuses on the legislation regarding nature reserves.
Nature reserves can be established, inter alia, to protect valuable natural areas and preserve biodiversity. Reserves can be formed on land owned by individuals, and through such decision certain types of land use can be prohibited, for example tree felling. When such restrictions are issued, the land owner has the right to financial compensation - under certain conditions.
For some time, scholars in environmental law have argued that the legisla-tion on nature preservation must be changed in order for more nature reserves to be established. The right to property, as expressed both in the Swedish constitution (RF) and the ECHR, hinders a legislation imposing greater responsibility on land owners. However, the protection of property in ECHR seem less far reaching than its equivalent in RF. Thus, if the Swedish constitution was changed, which I believe is necessary, more intrusive legislation on nature protection could be enacted without violating the ECHR.
Also traditional legal principles have been found to be problematic when legislation on nature preservation is to be enacted, as well as enforced. Seemingly apolitical rights for the protection of individuals against public intervention impedes an effective legislation. The society in which these principles evolved was, however, very different from today's. To strengthen the preservation of nature, it is my view that these principles must be changed. (Less)
