Förevarande uppsats behandlar det så kallade barnperspektivet och i vilken utsträckning detta blir tillgodosett i den svenska rättstillämpningen efter vårdnadsreformen år 2006. I förarbetena till 2006 års vårdnadsreform framgår att utgångspunkten i barnperspektivet är respekten för barnets fulla människovärde och integritet. Att anlägga ett barnperspektiv i beslutsprocessen handlar om att analysera vilka följder olika beslutsalternativ kan få för barnet. I detta ingår att lyssna på barnet och respektera det som en individ med egna uppfattningar.

Förevarande uppsats behandlar det så kallade barnperspektivet och i vilken utsträckning detta blir tillgodosett i den svenska rättstillämpningen efter vårdnadsreformen år 2006. I förarbetena till 2006 års vårdnadsreform framgår att utgångspunkten i barnperspektivet är respekten för barnets fulla människovärde och integritet. Att anlägga ett barnperspektiv i beslutsprocessen handlar om att analysera vilka följder olika beslutsalternativ kan få för barnet. I detta ingår att lyssna på barnet och respektera det som en individ med egna uppfattningar.

En redogörelse för principen om barnets bästa och bestämmelserna om barnets rätt att komma till tals i mål om vårdnad utgör en viktig del i den deskriptiva delen av uppsatsen. Ett klargörande av dessa begrepp är nödvändigt för att kunna fastställa definitionen av barnperspektivet.

Uppsatsen innehåller en rättsfallsundersökning med syftet att undersöka i vilken utsträckning barnperspektivet blir tillgodosett i rättstillämpningen beträffande mål om vårdnad. Fokus ligger på tiden efter 2006 års vårdnadsreform. Sammanlagt ingår 44 domar i undersökningen. Studien visar att 21 av domarna innehåller ett barnperspektiv, 21 av domarna innehåller förvisso en individualiserad bedömning av omständigheterna i det enskilda fallet men utan att barnet ges en betydande roll i processen och två av domarna saknar en individuell bedömning över huvud taget.

I uppsatsens avslutande del konstateras sammanfattningsvis att det finns allvarliga brister i domstolarnas handläggning beträffande ett tillgodoseende av barnperspektivet och barnets rätt att komma till tals processen. Rättsfallsstudien visar dock att 2006 års vårdnadsreform har haft viss inverkan på rättstillämpningen beträffande domstolarnas tillgodoseende av barnperspektivet i processen. (Less)

The main purpose of this thesis is to discuss the concept of the child’s perspective and in what extent it is met in the Swedish judicial practice, focusing on the time after the custody reform of 2006. The preparatory work concerning the reform holds numerous of guidelines for the definition of the child’s perspective. The foundation of the concept is the respect of the child’s full human dignity and integrity. This includes listening to the child and respects it as an individual with his or her own beliefs and opinions.

The main purpose of this thesis is to discuss the concept of the child’s perspective and in what extent it is met in the Swedish judicial practice, focusing on the time after the custody reform of 2006. The preparatory work concerning the reform holds numerous of guidelines for the definition of the child’s perspective. The foundation of the concept is the respect of the child’s full human dignity and integrity. This includes listening to the child and respects it as an individual with his or her own beliefs and opinions.

The descriptive part of the thesis contains an explanation of the principle of the best interests of the child, as well as a detailed account of the regulations concerning the right of the child to express his or her views in all matters affecting the child. A clarification of these principles is necessary when establishing a definition of the child’s perspective.

In this work, an investigation is made into the application by the courts of appeal of the legislative rules introduced in 2006, which aimed to increase the child’s perspective in the legal process. There are a total of 44 cases in the study. The result shows that 21 of the cases contain a child’s perspective. There are 21 cases with major shortcomings concerning the satisfaction of a child’s perspective. All of these cases contain an individualized assessment concerning the overall circumstances, but there has been no effort to make a description of the individual child. Finally there are two cases completely lacking an individual assessment.

In the concluding part of the thesis it becomes obvious that there are serious flaws in the courts handling of cases in regards to taking into account the child’s perspective. The legal case study shows, however, that the custody reform of 2006 has had some effects on the application of the law regarding the courts satisfaction of the child’s perspective in the legal process.
