- Det finns huvudsakligen två typer av polygama äktenskap i svensk rätt. Det första är fall av tvegifte, vilka utgör ett brott enligt 7 kap. 1 § BrB. Det andra är fall av polygama äktenskap som ingåtts i utlandet. Polygama äktenskap som ingåtts i utlandet erkänns i Sverige under förutsättning att personerna vid äktenskapets ingående saknade anknytning till Sverige. Därutöver krävs att det polygama äktenskapet var lagligt i landet där det ingicks. Dessa äktenskap anses sedermera inte utgöra olagliga fall av tvegifte eftersom de skyddas av bestämmelsen om dubbel straffbarhet i 2 kap. 2 § 2 st BrB.

Uppsatsen behandlar dels hur den svenska rätten hanterar polygama äktenskap, dels vilka tillämpningsproblem som kan uppstå när den svenska lagstiftningen ska appliceras på dessa äktenskap. Tillämpningsproblematiken kommer att redogöras med fokus på den problematik som kan uppstå när kvarlåtenskapen efter make/maka i ett polygamt äktenskap ska fördelas.
Uppsatsen avslutas med en analys som präglas av en diskussion beträffande den brist på förutsebarhet som rättsläget idag medför. Personerna i de polygama äktenskap som erkänts i Sverige idag lever i en form av rättsligt vakuum. Främst pga. att frågan om huruvida polygama äktenskap ska anses strida mot svensk ordre public eller inte fortfarande inte har blivit avgjord. Även om polygama äktenskap ska anses strida mot svensk ordre public eller inte så kvarstår problematiken beträffande den svenska lagstiftningens förhållningssätt till dessa äktenskap. - There are mainly two types of polygamous marriages in Swedish law. The first is the case of bigamy, which constitutes a crime under Chapter 7. § 1 of the Swedish Penal Code. The second is the case of polygamous marriages contracted abroad. Polygamous marriages contracted abroad are recognized in Sweden, provided that the persons in the marriage lack any kind of connections to Sweden. In addition, the polygamous marriage must be legal in the country where it was contracted. These marriages are therefore not considered to constitute illegal cases of bigamy as they are protected by the double criminality clause in Chapter 2. 2 § 2 of the Swedish Penal Code.

A monogamous marriage, meaning that marriage shall be concluded between two people, is the cornerstone of the Swedish marriage regulation. This paper discusses how the Swedish law handles polygamous marriages, and what problems that can emerge when the Swedish legislation is applied to these marriages. The problem of application will be discussed focusing on the problems that can occur when the estate of a surviving spouse in a polygamous marriage is to be divided.
The paper is concluded with an analysis characterized by a discussion of the lack of predictability that the legal situation today entails. The people in the polygamous marriages recognized in Sweden today are living in a kind of legal vacuum. Mainly due to the fact that the question if polygamous marriages should be considered contrary to Swedish ordre public or not, has still not been settled. Whether they should be considered contrary to Swedish ordre public or not, the problem remains as to how Swedish law should approach these marriages. (Less)
