Den negativa religionsfriheten - Med fokus på skolavslutningen

I vissa svenska kommunala grundskolor har skolavslutningar i kyrkan länge varit en tradition. Skolverket och skolinspektionen uttalar att skolavslutningar får hållas i kyrkan och att vissa religiösa inslag så som psalmsång får förekomma. I svensk lagstiftning finns dock inget direkt stöd för att skolavslutningar får hållas i kyrkan. Med anledning av detta meddelade riksdagens utbildningsutskott i april 2016 att man är för att en lagändring ska ske som slår fast att skolor får hålla sina avslutningar i kyrkan. Målet tycks vara att slå fast den praxis som skolverket och skolinspektionen redan tillämpar.

I svensk lagstiftning finns dock inget direkt stöd för att skolavslutningar får hållas i kyrkan. Uppsatsen syfte är att undersöka om den praxis som skolverket och skolinspektioner ställt upp verkligen är förenligt med skyddet för den negativa religionsfriheten. För att avgöra detta kommer uppsatsen behöva fastställa de gränsdragningar som kan anses finnas för den negativa religionsfrihetens omfattning. För att komma fram till detta krävs en undersökning och jämförelse mellan regeringsformen, EKMR, Europadomstolens praxis och myndighetspraxis.

Uppsatsen strävar efter att ge en klarare bild av den negativa religionsfriheten och den praxis som är knuten till den. Vidare diskuteras avvägningen mellan olika skyddade intressen och vilket av dessa intressen som ska väga tyngs. Dessa intresseavvägningar diskuteras sedan i analysen.

Den svenska lagstiftningen uppställer idag ett krav på elevers närvaro vid skolavslutningarna, vilket aktiverar frågan kring om elevernas negativa religionsfrihet kan anses kränkas vi religiösa avslutningar. Kring denna fråga kan det föras argument för och emot att de religiösa traditionerna kränker elevernas rättigheter. Enligt min mening är skolavslutningarna i kyrkans lokaler förenliga med regeringsformen och EKMR. Skolavslutningarnas religiösa innehåll, däribland psalmsången, anses dock i min mening stå i strid med Europakonventionen och den negativa religionsfriheten. (Less)

In some Swedish municipal primary schools a common gathering in the local church at the end of every term is a well established tradition. The National Agencies for Education (Skolverket and Skolinspektionen) have come to the conclusion that these gatherings can take place in a church and that a certain degree of religious activities can take place, for example the singing of religious hymns. However, there is no support for this tradition to be found in Swedish legislation. Due to this the Education Committee (Utbildningsutskottet) stated that they support a modification in domestic law that states the right for schools to have these traditional gatherings in a local church. The purpose of this essay is to examine if the practice from the National Agencies for Education is compatible with the freedom of religion. In order to decide this we must first examine the limitations of this particular freedom. This will be done by examining and comparing the Swedish constitutional law, the European Convention on Human Rights, practice from the European court of Human Rights and practice from the domestic authorities.

The essay strives to give a better picture over the freedom of religion and the practice linked to it. The essay discusses the balance between different protected interests and which of these that will prevail. The different protected interest are discussed and analyzed.

Swedish legislation of today requires students to participate in these gatherings, which leads to the question if the students’ freedom of religion is being violated. There are arguments both for and against the view that religious elements at these gatherings are violating the students´ freedom of religion. In my view school gatherings in a church is compatible with the Swedish constitutional law and the European Convention on Human Rights. School gatherings with religious elements such as the singing of religious hymns are, however, in my opinion violating the students’ freedom of religion. (Less)
