- Den här uppsatsen diskuterar äktenskapet och dess okritiserade roll i den
svenska familjerätten. Det huvudsakliga syftet med uppsatsen är att granska
äktenskapet som en statligt reglerad samlevnadsform. Detta görs genom att
granska äktenskapets historia, gällande rätt, äktenskapets funktioner och
lagstiftarens överväganden vid reglering av intima relationer. Uppsatsen har
också ett kritiskt anslag, vilket innebär att ifrågasätta äktenskapet och dess
okritiserade roll som grunden för familjerätten. I denna del presenteras
kritik gentemot äktenskapet som en statligt reglerad samlevnadsform. I
uppsatsen undersöks också ett av de förslag som introducerats i den rättsliga

granska äktenskapets historia, gällande rätt, äktenskapets funktioner och
lagstiftarens överväganden vid reglering av intima relationer. Uppsatsen har
också ett kritiskt anslag, vilket innebär att ifrågasätta äktenskapet och dess
okritiserade roll som grunden för familjerätten. I denna del presenteras
kritik gentemot äktenskapet som en statligt reglerad samlevnadsform. I
uppsatsen undersöks också ett av de förslag som introducerats i den rättsliga
doktrinen bland de som anser att äktenskapet bör avskaffas. Förslaget
innebär att avtal bör vara grunden för människors möjlighet att uppnå
rättslig trygghet i förhållande till sina intima relationer.
Resultatet visar på att äktenskapet inte är ett flexibelt institut när det handlar
om individers möjlighet att anpassa vilka effekter äktenskapet får i
förhållande till deras relation. Resultatet visar också på att regleringen kring
äktenskapet är kopplat till lagstiftarens föreställningar om hur en intim
relation bör se ut. Lagstiftarens föreställningar bygger på att äktenskapet är
en tvåsam relation som bygger på sexualitet och familjebildning. Denna
föreställning innebär i förlängningen att reglering för andra sorters intima
relationer, såsom vuxna syskon, vänner, polyamorösa förhållanden etc. inte
anses vara nödvändigt.
Rörande kritiken mot äktenskapet visar resultaten att äktenskapet kan
kritiseras på grund av att det är en institution som är frihetsbegränsande,
exkluderande, och som inte uppmuntrar till mångfald. Äktenskapet kan
också kritiseras för att det är en reglering som bygger på form före funktion,
och för att äktenskapet är ett förlegat institut som inte är anpassat till vår
samtid. Kritiken visar på att äktenskapsrätten är i behov av nya perspektiv.
Avtalsförslaget fungerar som ett av dessa nya perspektiv. Undersökningen
av avtalsförslaget visar på att äktenskapets funktioner i en samtida kontext,
såsom dess ekonomiska, symboliska och familjebildande värde kan uppnås
även i förhållande till avtalsförslaget. Detta tyder på att äktenskapet har
tagits för givet som det bästa sättet att reglera intima relationer, utan att
vidare ifrågasättas. Analysen föreslår att detta antagande behöver utmanas
ytterligare. Målet bör vara att regleringen rörande intima relationer stämmer
överens med den pluralism av intima relationer som existerar i vår
postmoderna och normbrytande samtid. (Less) - Abstract

law. The main purpose of the essay is to examine marriage as a state
regulated form of intimate relation between individuals. The essay examines
the history of marriage, the applicable law, the function of marriage and the
legislator’s considerations when it comes to legislation concerning intimate
relations.
This paper also has a critical approach, which means that the paper
questions marriage as the foundation of family law. The critical approach is
based on a norm-critical and postmodern view. In the critical approach, the
essay examines critique against marriage as regulated by the state. The

favor of abolishing marriage. The proposal entails the use of contract as the
basis of legal security in intimate relations.
The results show that marriage is inflexible when it comes to individuals’
possibilities to adjust the applicable law to suit their relationship. The results
also show that the regulation of marriage is linked to the legislators idea of
what an intimate relation should be composed of. In this regard, marriage is
viewed as a binate relation built on sexuality and having children. This view
results in the absence of regulation concerning other forms of intimate
relations, such as adult siblings, friends, polyamorous relationships etc.
Regarding the critique against marriage, the results show that marriage can
be criticized since it is excluding, discouraging of diversity and limiting in
regard of freedom. The results also show that marriage is based on form
rather than function and that it is a stale institute not adapted to our time.
This critique amounts to the need of new perspectives on the marriage
regulation. The proposal of contract serves as one of these new perspectives.
The examination of the proposal of contract shows that the functions of
marriage in our time, such as its economic, symbolic, and family value also
can be attained in regard to the proposal contract. This shows that marriage
has been taken for granted as the best way to regulate intimate relations. The
analysis suggests that this assumption needs to be questioned further, in
order to make sure that the legal regulation concerning intimate relations is
adapted to the pluralism of intimate relations in our postmodern and norm
