Sekretess inom skolans särskilda elevstödjande verksamhet

Till skolan kommer elever med olika förutsättningar för sitt lärande. För en del elever är den ordinarie undervisningen inte tillräcklig för att nå uppsatta läromål. Inom den s.k. särskilda elevstödjande verksamheten kan skolan vidta åtgärder för elever som är i behov av extra stöd i lärandet. Inom sådan verksamhet kan uppgifter vara av allt ifrån integritetskänslig till harmlös karaktär.

Offentlighetsprincipen begränsas av vissa sekretessregler för att inte all information ska vara tillgänglig för allmänheten. Inom den s.k. särskilda elevstödjande verksamheten kan skolan vidta åtgärder för elever som är i behov av extra stöd i lärandet. Inom sådan verksamhet kan uppgifter vara av allt ifrån integritetskänslig till harmlös karaktär.

Offentlighetsprincipen begränsas av vissa sekretessregler för att inte all information ska vara tillgänglig för allmänheten. I nuläget finns för uppgifter från den särskilda elevstödjande verksamheten ett sekretesskydd med presumtion för offentlighet, dvs. ett s.k. rakt skaderekvisit. Skolans verksamhet kompliceras av att olika delar tillämpar olika sekretessregler. Vidare behöver skolans personal beakta att det finns sekretessbrytande bestämmelser som gör att informationsutbyte kan ske mellan skolans s.k. självständiga verksamhetsgrenar samt mellan skolan och andra myndigheter.

Med anledning av den ökade dokumentationsskyldigheten i skolväsendet tillkallade regeringen en särskild utredare i SOU 2011:58 för att bl.a. se över om sekretesskyddet för uppgifter om elevers personliga förhållanden i den särskilda elevstödjande verksamheten behöver förändras till ett starkare sekretesskydd, dvs. ett omvänt skaderekvisit. I utredningen och efterföljande remissvar lyftes argument för och emot en sådan ändring fram.

För det första utreds i uppsatsen huruvida nuvarande sekretessreglering ger tillräckligt skydd för uppgifter inom den särskilda elevstödjande verksamheten. För det andra utreds i uppsatsen om reglerna om sekretess mellan och inom myndigheter ger tillräckligt skydd för uppgifter inom den särskilda elevstödjande verksamheten vid sådant informationsutbyte. För det tredje utreds i uppsatsen behovet av ytterligare skydd i form av ett omvänt skaderekvisit för uppgifter om elevers personliga förhållanden i den särskilda elevstödjande verksamheten.

I uppsatsen dras bl.a. slutsatsen att nuvarande sekretesskydd för uppgifter inom den särskilda elevstödjande verksamheten inte ges ett tillräckligt skydd. Vidare dras slutsatsen att reglerna för sekretess mellan och inom myndigheter fungerar relativt väl med nuvarande reglering men att en lagändring skulle kunna ha en positiv inverkan och underlätta skolans samverkan med andra myndigheter. Slutligen dras slutsatsen att en lagändring som skapar ett starkare sekretesskydd för uppgifter inom den särskilda elevstödjande verksamheten är nödvändig för att värna om de bakomliggande skyddsintressena men att en sådan ändring bör utformas så att offentlighetsprincipen inskränks i minsta möjliga mån. Students come to school with different settings for their learning. For some students the regular teaching is not sufficient to achieve the set learning goals. In the so-called special student support activities (Sw. särskild elevstödjande verksamhet), the school can take action for students who are in need of extra support in their learning. In the so-called special student support activities (Sw. särskild elevstödjande verksamhet), the school can take action for students who are in need of extra support in their learning. Within such activities, data can range from sensitive to harmless character.

The principle of public access to official records is limited by certain confidentiality rules, since not all of the information should be accessible to the public. The current protection, for the information in the special student support activities, is a confidentiality protection with a presumption of public access, i.e. a so-called straight damage requirement. School activities are complicated by the different confidentiality rules that apply for different areas. Further, the school staff must consider that there are confidentiality breaking rules that enable exchange of information between the school’s so-called independent branches of activities and between the school and other authorities.

Because of the increased documentation obligation in the school system, the Swedish government set up a special investigator in SOU 2011:58 to review among other things if the confidentiality protection for students’ personal circumstances within the special student support activities need to be changed to a stronger confidentiality protection, i.e. a reverse damage requirement. The inquiry and subsequent responses to the inquiry raised arguments for and against such an amendment.

Firstly, this essay examines whether or not the current confidentiality regulation provides adequate protection of data regarding the special student support activities. Secondly, this essay examines if the confidentiality rules between and within authorities adequately protect data within the special student support activities where such information is exchanged. Thirdly, this essay scrutinizes the need for additional protection in the form of a reverse damage requirement for data regarding students’ personal circumstances within the special student support activities.

In the essay, one conclusion among others is drawn that the current confidentiality protection for information within the special student support activities is not given adequate protection. Furthermore it is concluded that the confidentiality rules between and within authorities are working relatively well, but that an amendment of the law would have a positive impact and facilitate the collaboration between the school and other authorities. Finally, it is concluded that an amendment that creates a stronger confidentiality protection for information within the special student support activities is necessary, however such amendment should be designed so that the principle of public access to official records is restricted to the least possible degree.
