The debate about rape against women has been active in Sweden for many years. For instance there have been some criticisms that only a few women choose to report the crime to the police, and how the woman as a victim is treated during the legal action. The purpose of this essay has been to analyse how female victims are constructed in court judgements concerning rape in Sweden. I have based on a qualitative research approach, made a text analyse of court judgements concerning rape with the aim on how female victims have been described. The court judgements are from 2014-2015. The empirical findings have been analysed from a social constructive perspective and a gender perspective. The results showed mainly how the woman was described based on the ideals and stereotypical norms that exist about victims of sexualcrimes and women in general. Sometimes the woman was described by conditions that have no legal relevance, such as her sexuality.

Keywords: rape, victim, gender, social constructivism. (Less)
