- Länsstyrelsernas handläggning av samråd enligt reglerna i miljöbalken problematiseras utifrån en rättviseaspekt. Detta görs utifrån resurssvaga sakägares perspektiv. Som rättvisenorm används artikel 9.4 i Århuskonventionen.
Det framkommer att framförallt det handläggarstöd som länsstyrelserna gemensamt har arbetat fram är problematiskt då det ensidigt betonar förhållandet till den sökande. Vidare förhindrar kravet på opartiskhet länsstyrelserna att kompensera för olikheter i resurser mellan sökande och sakägare på det sätt som är önskvärt enligt Århuskonventionen. - Abstract
- The role of The County Adminstrative Board in connection to the consultative phase of environmental proceedings is discussed in relation to a sense of fairness from the point of view of interested parties with limited resources. Article 9.4 of the Aarhusconvention is found to be a norm against which fairness can be judged.
Some problems with the existing regulations are identified. The common handbook for how the County Administrative Boards are to act during the consultative phase concentrates on the relationship with the applicant to such a degree that fairness according to The Aahusconvention cannot be guaranteed. Furthermore the demand for impartiality makes it impossible to compensate for inequality when it comes to resources...
