Hur påverkas efterlevande makes arvsrätt av ett hemvistbyte från Sverige till Spanien?

- Genom EU-förordningen 650/2012 om internationella arvsfrågor har nationalitetsprincipen bytts mot hemvistprincipen med avseende på vilket lands arvsregler som ska tillämpas inom EU. Ingen harmonisering har dock skett av arvsrätten inom EU, och i den situation att en person byter hemvistland inom EU blir det således angeläget att jämföra ländernas arvsregler och vid behov upprätta testamente. Åtskilliga svenska medborgare har bytt hemvistland från Sverige till Spanien vilket innebär att svenska arvsregler, som prioriterar efterlevande make före gemensamma bröstarvingar, byts mot spanska arvsregler, som i stället prioriterar samtliga bröstarvingar framför efterlevande make. Makarna har dock möjlighet att genom testamente disponera över sin kvarlåtenskap och förordna att svensk arvsrätt ska gälla även efter bytet av hemvistland. Ett svenskt testamente är giltigt i Spanien, men ett arvskifte som genomförs i Spanien torde påskyndas om det finns ett spanskt testamente. (Less)

- According to EU regulation no 650/2012 regarding international succession, the applicable law governing succession has shifted from the law of the state of nationality to the law of the state of habitual residence. Since the laws of succession in EU member states have not been harmonized, the situation where a person changes his or her state of habitual residence within the EU calls for a comparison of the succession laws, and might require the making of a will. Many Swedish citizens have changed their state of habitual residence from Sweden to Spain with the effect that Swedish law regarding succession, which gives priority to the spouse of the deceased before their common descendants, is replaced by Spanish law, which gives priority to... - According to EU regulation no 650/2012 regarding international succession, the applicable law governing succession has shifted from the law of the state of nationality to the law of the state of habitual residence. Since the laws of succession in EU member states have not been harmonized, the situation where a person changes his or her state of habitual residence within the EU calls for a comparison of the succession laws, and might require the making of a will. However, the spouses may dispose of their estate in a will and state that Swedish law regarding succession shall apply even after they have changed their state of habitual residence.
