Genom en större lagreform, från år 2004, infördes nya bestämmelser i 6 kap., bland annat i syfte att förstärka skyddet för barn mot sexuella övergrepp. En av dessa var bestämmelsen om våldtäkt mot barn som bland annat kriminaliserar samlag eller med samlag jämförlig handling med barn under femton år. En lindrigare form av våldtäkt mot barn, sexuellt utnyttjande av barn, infördes med samma reform. Denna är avsedd att tillämpas restriktivt, och tar sikte på situationer då offret är nära åldern för sexuellt självbestämmande och samlaget eller den med samlag jämförliga handlingen sker frivilligt och ömsesidigt. En lindrigare form av våldtäkt mot barn, sexuellt utnyttjande av barn, infördes med samma reform. Denna är avsedd att tillämpas restriktivt, och tar sikte på situationer då offret är nära åldern för sexuellt självbestämmande och samlaget eller den med samlag jämförliga handlingen sker frivilligt och ömsesidigt. Uppsatsens syfte är att undersöka gränsdragningen mellan dessa två brottsrubriceringar. Uppsatsens frågeställningar lyder ”Vilka omständigheter kan göra att brottet, våldtäkt mot barn, är att ses som mindre allvarligt?” och ”Är rättstillämpningen förenlig med lagstiftarens intentioner vid gränsdragningen av de två brotten”. Uppsatsen anlägger en typ av barnperspektiv som grundar sig i vetskapen om att barn och tonåringar lever i särskild utsatthet och är benägna att ta risker på ett annat sätt än vuxna. Lagmotiven ger ut vissa motsägelsefulla uttalanden beträffande barns förmåga att samtycka till och frivilligt delta i sexuella handlingar. Det hävdas att barn aldrig kan samtycka till sexuella handlingar, men också att man ska beakta frivilligheten för att kunna utröna huruvida den lindrigare bestämmelsen blir tillämplig i stället. Högsta domstolen har vid några tillfällen fått göra avvägningar mellan dessa två rubriceringar i sin bedömning. I nästintill samtliga av de i uppsatsen redogjorda fallen har domstolen dömt den tilltalade för den lindrigare formen, det vill säga sexuellt utnyttjande av barn. Omständigheterna som gjort att domstolen dömt till den lindrigare formen har främst varit målsägandens ålder, huruvida handlingen var frivillig från målsägandens sida samt huruvida gärningsmannen uppfattade handlingen som frivillig från målsägandens sida. De två första avgörandena som kom efter reformens ikraftträdande är omdebatterade. I synnerhet har frivillighetsaspekten diskuterats. Min åsikt är att Högsta domstolens rättstillämpning inte är helt förenlig med lagförarbetena, särskilt
med tanke på den i lagmotiven tydliga utgångspunkten att barn under femton år inte kan samtycka till sexuella handlingar. Lagstiftarens intentioner är emellanåt svåra att tolka, och uttalandena om frivillighet är ibland motsägelsefulla. Men mot bakgrund av det tydliga syftet med regleringen, att förse barn med ett starkare skydd mot sexuella övergrepp, finner jag att domstolen har varit för milda i brottsrubriceringsfrågan. (Less)

One of these was the provision regarding child rape that outlaws intercourse or comparable actions to intercourse with children under the age of fifteen. A minor form of child rape, sexual use of children, was implemented with the same reform. This was intended to be applied restrictively and aims for situations where the victim was close to the age for sexual self-determination and the intercourse or the with intercourse comparable action transpired voluntarily and mutually. In 2004, reforms were made in chapter 6 of the Penal Code in regards to strengthen the protection for children against sexual assaults. One of these was the provision regarding child rape that outlaws intercourse or comparable actions to intercourse with children under the age of fifteen. A minor form of child rape, sexual use of children, was implemented with the same reform. This was intended to be applied restrictively and aims for situations where the victim was close to the age for sexual self-determination and the intercourse or the with intercourse comparable action transpired voluntarily and mutually. The purpose of this essay is to examine the boundary set between these two offenses. The questions are “what circumstances makes the crime of raping a child less serious” and “how the legal application is in congruence with the intentions of the legislator. The essay assumes a type of child-perspective that is based on the knowing that children and teenagers live especially exposed and are more prone to take risks than adults. The legislative history gives partially contradictory statements regarding children’s ability to consent and volunteer to sexual actions, where it’s partially stated that children never can consent to sexual actions, however at the same time one should consider the voluntariness to determine whether the milder provision applies instead. In the Supreme Court there have been a few occasions where the borderline between the two offenses have been assessed. In almost all of the cases recited in the essay the court has sentenced the accused for the minor form, sexual use of children. The circumstances that have influenced the court to have sentenced the minor form have primarily been the plaintiffs age, whether the actions were voluntarily agreed to from the plaintiff as well as how the accused had understood the action as voluntary from the plaintiffs’ side. The first two decisions that were made after the reform’s entry into force are rather debated. In particular, the voluntariness-aspect has been discussed. In my opinion the Supreme Court’s in law hasn’t been completely compatible with the legislative work, much due to the clear starting point that children under fifteen years of age can’t consent to sexual actions. Although the legislator’s intentions are sometimes hard to interpret, and the statements regarding voluntariness are somewhat contradictory. However, with the background of the explicit purpose of the control – to provide children with a greater protection towards sexual assaults – I find that the court have been too generous regarding classification.
