- Child- and forced marriages raises questions of both legal and moral characteristics. That children are forced into marriage is an internationally spread problem with mainly cultural, religious and economic motives. How the Swedish legal system should be formed must be in conformity with our international commitments, such as the convention on the rights of the child. The purpose of this paper is therefore to examine what requirements the convention and the principle of the best interest of the child sets, and how Swedish law caters these. Swedish legislation does not accept marriage before the age of 18 and forcing someone to marry against their will is a crime. - Child- and forced marriages raises questions of both legal and moral characteristics. That children are forced into marriage is an internationally spread problem with mainly cultural, religious and economic motives. How the Swedish legal system should be formed must be in conformity with our international commitments, such as the convention on the rights of the child. The purpose of this paper is therefore to examine what requirements the convention and the principle of the best interest of the child sets, and how Swedish law caters these. Swedish legislation does not accept marriage before the age of 18 and forcing someone to marry against their will is a crime. A marriage entered abroad is never recognised if it was entered against one spouses will, and child marriages are not recognised if one of the spouses had a connection to Sweden at the time of the wedding. Regarding marriages where none of the spouses had any connection to Sweden, the principle of ordre public forbids recognition of any marriage entered by someone younger than 15 years old.
The convention does not regulate child marriages but a number of articles could be interfered with, such as the right to education and development and the right to protection. The best interest of the child should be considered in relation to the rights set out in the convention and the opinions of the child should be taken in to account. Overall, Swedish law meets the requirements of the convention regarding marriages entered with a Swedish connection. The different view on what kind of threat that must have been used and how we assess a child’s consent to marriage is however questionable, since it differs from marriages entered with a connection to Sweden compared to those without. Children that entered into marriage with no connection to Sweden can live as married even though our national right forbids it and therefore they do not enjoy the same protection. För äktenskap utan anknytning till Sverige anses 15 år vara lägsta gräns för när ett äktenskap kan erkännas enligt ordre public-förbehållet.
Barnkonventionen saknar förbudsreglering mot barnäktenskap men många artiklar kan aktualiseras indirekt, t.ex. barnets rätt till utveckling och utbildning samt skydd mot övergrepp. Barnets bästa är ett svårdefinierat och flytande begrepp som i vart fall ska bedömas mot bakgrund av barnkonventionen, kunskap om barn i allmänhet samt barnets egna åsikter. Sammantaget får svensk rätt rörande svenskanknutna äktenskap anses tillgodose konventionen och principen om barnets bästa, då vi värnar om barnets frivillighet och tillförsäkrar ett heltäckande rättighetsskydd. Att det krävs högre nivåer av tvång för att underkänna ett utländskt äktenskap gentemot vad som krävs för att straffa någon för tvångsäktenskap i Sverige är däremot något att ifrågasätta. Även en skild syn på ett samtyckes rättsliga verkan är tämligen märklig. Att barn kan leva som gifta i Sverige till följd av ett erkännande uppfyller inte kraven på icke-diskriminering och eftersom de barn vars äktenskap erkänns inte ges ett fullgott skydd är det tveksamt om kraven enligt barnkonventionen och barnets bästa tillfredsställs fullt ut.
