- Abstract
- The constitution provides that particularly intervening obligations for the individual shall be regulated by law, thus by Parliament. Yet examples of practices shows the Swedish tax agency exercises arbitrary in terms of visibility to calculate the basis for taxation and to prevent tax evasion.
Visibility is also called the real meaning of legal acts and is a principle from the Supreme Administrative Court to be used in tax calculation. The principle, however, has never come to be enshrined in law, and has in recent decades been debated whether it’s actually to be applied, and whether the Supreme Administrative Court still does. Criticism is also about that visibility should be considered a method to establish a legal fact and not a principle to establish a legal consequence. - I regeringsformen stadgas att särskilt ingripande skyldigheter för den enskilde ska regleras genom lag, följaktligen av riksdagen. Trots det finns det exempel i praxis på att skatteverket i sin handläggning utövar ett godtycke i form av genomsyn för att beräkna underlaget för beskattning och för att hindra skatteflykt.
Genomsyn kallas även för rättshandlingars verkliga innebörd och är en av Regeringsrätten myntad tolkningsprincip vid skatteberäkningen. Principen har dock aldrig kommit att lagfästas och har under de senaste årtiondena varit omdebatterad huruvida den faktiskt ska få tillämpas och huruvida Högsta Förvaltningsdomstolen fortfarande gör det.
