Straffrättens legitimitet - Om bestraffning och dess legitimitet i en rättsstat

Jag har i denna uppsats försökt besvara frågan om hur en stat kan legitimeras att bestraffa sin befolkning. Detta för att jag anser att en sådan diskussion bör föras i en rättsstat. Jag har gjort det genom att läsa flera namnkunniga filosofer och jurister. Jag har redogjort för deras syn på bestraffning och även grunden till hur samhället som sådant har legitimitet. Därtill har jag analyserat ett antal lagrum var jag anser att de teorier som framställts kommer i konflikt med varandra. Vad jag vidare kommit framtill är att både den retributivistiska och den instrumentalistiska synen på straff kan legitimeras, så länge de motiveras på ett konsekvent sätt.
Abstract
I have in this thesis been trying to answer the question of how a state legitimately can punish their citizens. I am of the opinion that this kind of discussion is needed in a state governed by law. I have gathered information by reading a number of renowned philosophers and jurists. I have accounted for their view of punishment and the foundation on which the society is legitimated. To that, I have analysed a number of sections of the law where I consider the theories, which is presented, is coming in conflict with one another. I have further reached the conclusion that both the retributive and the instrumental views on punishment can be legitimate, as long as they are motivated in a consequent manner.
