Försvarsadvokaten och yppandeförbudet - En munkavel för rättsäkerheten?

- Kritiken mot yppandeförbudet från advokathåll handlar dels om huruvida yppandeförbudet påverkar försvararens roll, dels obalansen mellan parterna i brottmålsprocessen som yppandeförbudet påstås ge upphov till. Uppsatsens syfte är att utreda om ett yppandeförbud påverkar försvararens roll, likställdheten mellan parterna och om det i sådana fall påverkar rättssäkerheten. Försvararens roll definieras i VRGA och RB medan likställdheten mellan parterna garanteras enligt principen om equality of arms och kontradiktionsprincipen som bägge återfinns i EKMR och praxis. Yppandeförbud kan beslutas på två sätt: av åklagare enligt 23 kap 10§ sista st. RB vid förhör eller av domstolen vid häktesförhandling enligt 5 kap 4§ RB. Fokus ligger framförallt på... (More)

Uppsatsens syfte är att utreda om ett yppandeförbud påverkar försvararens roll, likställdheten mellan parterna och om det i sådana fall påverkar rättssäkerheten. Att yppandeförbudet påverkar advokatrollen framkommer tydligt. Det är däremot inte lika självklart om yppandeförbudet står i strid med de processrättsliga principerna, men det pekar åt det hållet. För lagstiftaren blir det en fråga om vad som är viktigast att prioritera: effektiviteten i brottmålsprocessen eller rättssäkerheten. Om man vill förändra instrumentet kan man antingen påverka meddelarfriheten eller effektiviteten genom att förflytta kompetensen att besluta om yppandeförbud från åklagaren till tredje part (Less) - Abstract

The purpose of this essay is to investigate if the prohibition affects the role of an attorney, the equality between the parties and whether it affects the legal certainty. The role of an attorney is defined in Code of Conduct of the Swedish Bar Association and The Swedish Code of Judicial Procedure, while the equality between the parties is to find in ECHR and court practise. The prohibition against disclosure can be ordered in two ways: by the prosecutor during interrogations in accordance to the last subsection in section 10 chapter 23 in The Swedish Code of Judicial Procedure or by the court during custody negotiation in accordance to section 4 chapter 5 in The Swedish Code of Judicial Procedure. The primary focus of this essay is on the regulation in the last subsection in section 10 chapter 23 in The Swedish Code of Judicial Procedure.
It’s clear that the prohibition affects the role of an attorney. It is, however, not that clear if it’s in contrary to the procedural principal, but it’s leaning in that direction. For the legislature it’s a question about the most valuable thing to preserve: effectivness in criminal procedings or legal certainty. To change the the prohibition one can either affect the freedom of communication or the effectivness by moving the expertise from the prosecutor to a third party. (Less)
