- Marknadsföring är vanligt förekommande i dagens samhälle och marknadsföringsrätten är central när det gäller att avgöra om marknadsföringen är lagligt utformad. All marknadsföring är ägnad att påverka en eventuell konsument till att fatta ett affärsbeslut. Aggressiv marknadsföring har genom alla tider ansetts otillbörlig i Sverige. - Marknadsföring är vanligt förekommande i dagens samhälle och marknadsföringsrätten är central när det gäller att avgöra om marknadsföringen är lagligt utformad. All marknadsföring är ägnad att påverka en eventuell konsument till att fatta ett affärsbeslut. Aggressiv marknadsföring har genom alla tider ansetts otillbörlig i Sverige. Till följd av att direktiv 2005/29/EG om otillbörliga affärsmetoder implementerades i svensk rätt, infördes en specifik bestämmelse mot aggressiv marknadsföring i marknadsföringslagen (MFL). Detta skedde i form av ett förbud i 7 § MFL och bestämmelsen omfattar aggressiva beteenden såsom trakasserier, tvång, fysiskt våld, hot eller annat aggressivt påtryckningsmedel. Marknadsföring anses otillbörlig om den ”i märkbar mån påverkar eller sannolikt påverkar mottagarens förmåga att fatta ett välgrundat affärsbeslut”. Sverige kritiserades dock för att inte korrekt implementerat artikel 9 i ovan nämnda direktiv. En ändring av reglerna om aggressiv marknadsföring skedde därför i mars år 2016 genom att en tilläggsparagraf (7 a §) infördes för att förtydliga vad som avses med aggressiv marknadsföring i 7 § MFL. I 7 a § MFL anges också de omständigheter som kan vara av betydelse vid tillämpningen av 7 § MFL.
Syftet med uppsatsen är att utreda innebörden av aggressiv marknadsföring enligt MFL samt undersöka hur den gällande bestämmelsen behandlats i praxis. För att uppnå syftet och besvara frågeställningarna kommer dels en rättsdogmatisk metod, dels en EU-rättslig metod att tillämpas på det utvalda materialet. Bestämmelserna i 7 § och 7 a § MFL kommer att tolkas i ljuset av artikel 8 och 9 i direktivet om otillbörliga affärsmetoder. Vidare kommer begreppen trakasserier, tvång och otillbörlig påverkan att utredas. Uppsatsen kommer även att behandla de aggressiva metoder som stadgas i svarta listan. Marknadsdomstolens praxis kommer vidare att analyseras för att försöka utreda hur förbudet mot aggressiv marknadsföring har tillämpats i svensk rättspraxis. (Less) - Abstract

As a result of the implementation of Unfair Commercial Practices Directive 2005/29/EC in Swedish law, the term aggressive marketing was introduced into the Swedish marketing law (MFL). The prohibition of aggressive marketing is provided in § 7 Marketing Act and includes harassment, coercion, physical violence, threats or other aggressive means of pressure. The marketing is considered to be unfair if it ”appreciably affects or probably affects the recipient’s ability to make a well-founded transaction decision”. Sweden was criticized for not having correctly implemented Article 9 of the above mentioned directive. An amendment of the rules on aggressive marketing was therefore made in March 2016 by an additional clause (§ 7a) which clarified the § 7 MFL. The § 7 a MFL states factors which may be relevant for the purposes of § 7 MFL.
The purpose of this thesis is to investigate the meaning of aggressive marketing according to the Marketing Act and examine the impact of the rule given in Swedish case law. In order to achieve the purpose and answer the questions, a legal dogmatic method and an EU legal method will be applied on the selected material. The provisions in § 7 and § 7 a Maketing Act will be interpreted in the light of article 8 and 9 of the Unfair Commercial Practices Directive. Furthermore, the terms harassment, coercion and undue influence will be investigated. The thesis will also oversee the aggressive methods given in the black list. The cases of the Swedish Market Court will further be analyzed and examined to investigate the effect in Swedish practice. (Less)
