- Svensk sjöfart har sedan oljekrisen i början av 1970-talet i olika omgångar haft svårt
att konkurrera på den internationella marknaden. Svenska rederier har saknat de
verktyg som flertalet andra sjöfartsnationer har haft för att kunna hålla nere
personalkostnaderna. Dessa verktyg har exempelvis bestått i parallella
sjöfartsregister. Svenskt tonnage har därför bekvämlighetsflaggats i register utanför
Sverige för att på så sätt bland annat kunna pressa ned personalkostnaderna.
SEKO-sjöfolk arbetar aktivt mot bekvämlighetsflaggningen för att kunna förhindra
ytterligare utflaggning av svenskt tonnage.
TAP-modellen har sina rötter I den principöverenskommelse som SEKO-sjöfolk och
SARF ingick 1997.

Avtalen är en alternativ kollektivavtalsmodell som gör det möjligt för svenska
rederier/managementbolag att bemanna sina svenskflaggade fartyg med
besättningsmedlemmar från länder utanför EES-området. TAP-avtalen fungerar
tillsammans med det statliga sjöfartsbidraget som en möjlighet för svenskflaggat
tonnage att förbättra sin konkurrensförmåga mot andra sjöfartsnationer.
TAP-avtalets består av tre juridiska dokument som var för sig reglerar olika delar av
kollektivavtalsmodellen. Ett protokoll som reglerar den ursprungliga
överenskommelsen från 1997. Ett tillämpningsavtal som reglerar hur stor del av
besättningen som får utgöras av TAP-anställda. Ramavtalet utgör det kollektivavtal
som den TAP-anställde ska förhålla sig till.
Samtliga TAP-anställda är numera av filippinsk härkomst. De TAP-anställda utför
samma arbetsuppgifter som de svenska besättningsmedlemmarna ombord. Trots detta
är Storsjöavtalet som är ett av de kollektivavtal som de svenska
besättningsmedlemmarna tillhör betydligt generösare i några avseenden. De TAPanställdas
situation faller dock inte inom ramen för vad som per definition är att
betrakta som social dumping. TAP-avtalen uppfyller I flera hänseenden mer än väl de
lagstadgade minimikraven. Det är dock inte möjligt att utifrån endast underlaget i
denna studie avgöra om de TAP-anställda är utsatta för social dumping eller ej. (Less) - Abstract

the Swedish shipping companies/management companies to hire crew members from
countries outside the EES-area. The TAP-agreement originates from the agreement
between SEKO-sjöfolk and SARF (Employers´ organisaition) in 1997. The TAPagreement
works together with the state funded shipping subsidy to enhance the
ability of the Swedish registered tonnages to compete with other countries flag
models. The legal construction of the TAP-agreement contains three legal documents.
The protocol regulate the original agreement from 1997 that is considered to be the
most fundamental part. The implementing agreement regulate the amount of the TAPquota
that the employer can hire. The framework is what could be described as a
collective agreement in the more traditional sense. This document regulates the rights
and duties of the crew member.
All the crew members that works on Swedish vessels today under TAP-agreement is
of Filipino nationality. These crew members perform the same duties as the Swedish
crew members. Despite the fact that the Storsjöavtalet (the Swedish collective
agreement) is in some ways much more generous than the TAP-agreement there is no
reason to assume that the situation of the Filipino crew members is to be concidered
as social dumping.
Even if there are some differences the TAP-agreement is in many way well above the
minimum standard that is required by law. However it is not possible based on this
study alone to determine if the crewmembers that are included in the TAP-agreement
are subject to social dumping or not. (Less)
