Solidaritet – en EUfemism? - Om solidaritetsprincipen i artikel 80 FEUF och EU-kommissionens föreslagna rättvisemekanism i COM(2016) 270 final

Abstract
The current situation at the external borders of Europe and within its territory has resulted in violations of the fundamental principle of non-refoulement and of fundamental human rights such as the right to life. During the summer of 2017, Member States will decide on a new legislative proposal from the European Commission regarding the common asylum system. The purpose of this reform is, inter alia, to ensure "a high level of solidarity between Member States". As a part of the proposal the commission is proposing a fairness-mechanism that will allocate asylum applications among the different EU member states. The current situation at the external borders of Europe and within its territory has resulted in violations of the fundamental principle of non-refoulement and of fundamental human rights such as the right to life. During the summer of 2017, Member States will decide on a new legislative proposal from the European Commission regarding the common asylum system. The purpose of this reform is, inter alia, to ensure "a high level of solidarity between Member States". As a part of the proposal the commission is proposing a fairness-mechanism that will allocate asylum applications among the different EU member states. By examining the principle of solidarity in Art. 80 TFEU as well as the proposed fairness-mechanism, this paper contributes to a greater understanding of the dynamics with in the Common Asylum System. These dynamics are today shaping and will in the future shape the protection attributed to protection seeking persons in Europe. As a first step this essay examines the principle of solidarity by mapping out migration law analyses of the principle. These analyses are then used to investigate the proposed fairness-mechanism. The paper concludes that the underlying logic of solidarity is a reason to why it is often called up on as a solution to migration crises. The essay also concludes that structural problems with in the principle, both in terms of its definition and its implementation, limit its potential. The essay finally finds that the proposed fairness-mechanism reproduces and in some ways, intensifies these structural problems. (Less)

Den nuvarande situationen vid Europas yttre gränser och inom dess territorium har medfört, och medför, överträdelser av den grundläggande principen om non-refoulement och grundläggande mänskliga rättigheter såsom rätten till liv. Sommaren 2017 ska medlemsstaterna i EU besluta om ett nytt lagförslagspaket från Europeiska kommissionen avseende det gemensamma asylsystemet. Sommaren 2017 ska medlemsstaterna i EU besluta om ett nytt lagförslagspaket från Europeiska kommissionen avseende det gemensamma asylsystemet. Genom att undersöka principen om solidaritet i art 80 FEUF och den föreslagna rättvisemekanismen bidrar uppsatsen till en ökad förståelse för några av de dynamiker inom det gemensamma asylsystemet som formar, och kommer att forma, det framtida skyddet för skyddsökande i Europa. Först undersöks solidaritetsprincipen genom att kartlägga migrationsrättsvetenskapliga analyser av principen. Dessa analyser används sedan för att undersöka den föreslagna rättvisemekanismen i reformförslaget till Dublinförordningen. Slutsatsen är att solidaritetsprincipens underliggande logik är en av anledningarna till att den ofta åberopas som en lösning på migrationskriser men att strukturella problem både i fråga om dess definition och implementering begränsar dess potential. Uppsatsen finner vidare att den föreslagna rättvisemekanismen reproducerar och på vissa sätt intensifierar dessa strukturella problem. (Less)
