Nödvärn med dödlig utgång - Förutsättningar för ansvarsfrihet vid angrepp som resulterar i angriparens död

- Abstract
- In the Swedish Penal Code’s 24th chapter, 1st and 6th paragraphs, it is stated that a person is not obliged to flee from an attack, but is allowed to stand his ground and defend himself. As the limit of what actions are considered allowed are dependant on the nature of the attack, the result of said self-defense can vary. The author seeks to illustrate this discrepancy between various actors of the judiciary and to find clarity as to what conditions may emancipate the defender from responsibility where said self-defense results in fatal outcome for the attacker.

- Av vad som följer av nödvärnsbestämmelserna i Brottsbalkens 24 kap. 1 och 6 §§ är en person inte skyldig att backa från ett angrepp, utan är tillåten att försvara sig för att freda sig och sin rättighetssfär. Då gränsen för vad som anses tillåtet att göra i självförsvar baseras på angreppets beskaffenhet, kan resultatet av självförsvaret bli väldigt skiftande. Författaren söker åskådliggöra diskrepansen mellan rättssystemets olika aktörer och finna klarhet i förutsättningar för ansvarsfrihet i ett läge som nödvärnshandlingen resulterat i dödlig utgång för angriparen.
