Oklarhet om hållbarhet i gruvlagstiftningen: En studie av hållbarhetsbegreppet i prövningen av bearbetningskoncession

- Den svenska minerallagen har varit föremål för kritik rörande dess oförenlighet med internationell rätt angående ursprungsfolks rättigheter, men dess relation till begreppet hållbarhet är relativt outforskat. Denna uppsats bidrar till förståelsen av detta förhållande genom att undersöka hur begreppet hållbarhet förstås i lagen och av relevanta myndigheter i samband med prövningen av bearbetningkoncession. För detta ändamål använder uppsatsen i sin första del en begreppsanalys för att konstruera tre olika hållbarhetsbegrepp: stark hållbarhet, svag hållbarhet och ekocentrisk hållbarhet. Denna uppsats bidrar till förståelsen av detta förhållande genom att undersöka hur begreppet hållbarhet förstås i lagen och av relevanta myndigheter i samband med prövningen av bearbetningkoncession. För detta ändamål använder uppsatsen i sin första del en begreppsanalys för att konstruera tre olika hållbarhetsbegrepp: stark hållbarhet, svag hållbarhet och ekocentrisk hållbarhet. Vidare identifieras fyra faktorer av betydelse för dessa begrepp. Resultaten används sedan som analysverktyg för att tolka och utvärdera de definitioner av hållbarhet som går att utläsa i relevanta juridiska källor. Slutsatsen är att hållbarhet, i den rätt och myndighetspraxis som är föremål för undersökningen, till övervägande del tar formen av svag hållbarhet. Denna slutsats dras med utgångspunkt i den vaga konceptualiseringen av hållbarhetsbegreppet i svensk rätt, bristande integration av ekologiska hänsyn i delar av prövningsprocessen, den vikt som ges åt samhällsekonomiska intressen och formuleringen av resursersdegradering som i det närmaste en icke-fråga, allt vilket understöds av en antropocentrisk syn på naturen. This essay aims to further the understanding of this relationship by exploring how the concept of sustainability is used in legal documents and by relevant authorities in the process of granting exploitation concessions. For this purpose an approach modelled after concept analysis is used to construct three different concepts of sustainability: strong sustainability, weak sustainability and ecocentric sustainability. The findings are then used as an analytical tool to interpret and evaluate the definitions of sustainability put forward by relevant legal sources. It is found that the concept of sustainability enshrined in swedish law and the practice of the administrative authorities, in the context of its relation to mining activities, takes the form of weak sustainability. This is due to the vague conceptualization of sustainability as a concept in swedish law, lacking integration of ecological consideration in parts of the administrative process, the pervasiveness of national economy as a weighty factor and the attitude towards degradation of natural resources, all of which are backed by an anthropocentric view of nature.
