- Efter andra världskriget dömdes de högsta nazisterna till dödsstraff och fängelse för de internationella brott som de begått under krigsåren. Detta mötte dock kritik. Syftet med arbetet har varit att undersöka delen av kritiken avseende att Nürnbergprocessen inte varit förenlig med legalitetsprincipen som är en viktig princip för rättssäkerheten. Frågeställningarna har varit hur tribunalen och segrarmakterna rättfärdigade processen i förhållande till principen, om domsluten var förenliga med principen och om något kunde gjorts annorlunda ifall kritiken var befogad.
Genom att ta del av material som uttrycker olika syn på detta förhållande samt även undersöka de officiella handlingarna som nämnt material kommenterar, t.ex. den stadga som... Syftet med arbetet har varit att undersöka delen av kritiken avseende att Nürnbergprocessen inte varit förenlig med legalitetsprincipen som är en viktig princip för rättssäkerheten. Frågeställningarna har varit hur tribunalen och segrarmakterna rättfärdigade processen i förhållande till principen, om domsluten var förenliga med principen och om något kunde gjorts annorlunda ifall kritiken var befogad.
Genom att ta del av material som uttrycker olika syn på detta förhållande samt även undersöka de officiella handlingarna som nämnt material kommenterar, t.ex. den stadga som den internationella domstolen dömde enligt, så har jag kommit fram till följande: Legalitetsprincipen förekommer i internationell rätt men den ser annorlunda ut än den legalitetsprincip som vi kanske är vana vid i vår inhemska rättsordning just för att den internationella rättsordningen har annorlunda rättskällor.
Därefter, med uppfattning kring hur legalitetsprincipen gäller internationellt, har jag kommit fram till att domsluten i vissa avseenden varit mer eller mindre kompatibla med den internationella legalitetsprincipen, men också varit relativt oförenlig med den i andra avseenden. Detta beror i sin tur på att frågan om legalitetsprincipens roll i förhållande till den internationella rättsordningen väcktes just i samband med processen och de bestämmande makterna hade antingen inte möjligheten eller prioriteringen att tillmötesgå den. - After World War II, the highest Nazis were convicted of the death penalty and imprisonment for the international crimes committed during the war. However, this met criticism. The purpose of this essay has been to examine the part of the criticism about the Nuremberg process not being compatible with the principle of legality, which is an important principle of legal certainty. The questions to aid me with this purpose have been how the tribunal and victory forces justified the process in relation to the principle, if the rulings were consistent with the principle and if something could have been done differently if the criticism was justified.
By taking part in material that expresses different views on this matter, as well as... (More) - After World War II, the highest Nazis were convicted of the death penalty and imprisonment for the international crimes committed during the war. However, this met criticism. The purpose of this essay has been to examine the part of the criticism about the Nuremberg process not being compatible with the principle of legality, which is an important principle of legal certainty. The questions to aid me with this purpose have been how the tribunal and victory forces justified the process in relation to the principle, if the rulings were consistent with the principle and if something could have been done differently if the criticism was justified.
By taking part in material that expresses different views on this matter, as well as investigating the official documents that these materials deal with, such as the statute which the international court used as its instruction, I have come to the following conclusion: The principle of legality has a place in international law but it looks different from the principle of legality that we may be used to in our domestic legal order and this mainly because the international legal order has different sources of law.
Then, with an understanding of how the principle of legality applies internationally, I have come to the conclusion that the ruling in some respects has been more or less compatible with the international legality principle but also relatively incompatible with that in other aspects. This in turn is due to the fact that the issue of the role of legality in relation to the international legal order was just brought about in connection with the process and the ruling powers either did not have the opportunity or priority to accommodate it.
