Modeprodukters rätt till skydd - Är det tillräckligt unikt?

Olika skyddsförutsättningar har under årens gång utvecklats för modebranschen som ständigt är under förändring. Dessa immaterialrätter består främst av upphovsrätt och mönsterrätt. Skydden överlappar ofta varandra. Just skyddet för modeprodukter har varit under kritik de senaste åren, det har ansetts vara otillräckligt. Hur modebranschen bör skyddas mot efterbildning råder det delade meningar om.

Upphovsrätten ställer krav på originalitet och verkshöjd. Skyddet uppkommer formlöst, medan mönsterrätten uppställer krav på särprägel och nyhet. Detta skydd uppstår genom registrering. Skydden överlappar ofta varandra. Just skyddet för modeprodukter har varit under kritik de senaste åren, det har ansetts vara otillräckligt. Hur modebranschen bör skyddas mot efterbildning råder det delade meningar om.

Upphovsrätten ställer krav på originalitet och verkshöjd. Skyddet uppkommer formlöst, medan mönsterrätten uppställer krav på särprägel och nyhet. Detta skydd uppstår genom registrering. De krav som uppställts är svårdefinierade vilket bidrar till en gråzon. I praxis har det framhållits att modebranschen får till skillnad från andra branscher tåla mer långtgående efterbildningar av deras skapelser.

Skyddet för modeprodukter sätts i relation till rätten till fri konkurrens på den inre marknaden. Dessa två intressen är till viss del motstående och hamnar i obalans och en proportionalitet mellan ändamål och syfte skulle behövas. Eftersom branschen är ombytlig är det viktigt med rotation och konkurrens samtidigt som brist på skydd hämmar det kreativa skapandet. Resultatet i dagsläget har blivit att modeprodukter i stort sett saknar ett reellt immaterialrättsligt skydd och närliggande efterbildning sker kontinuerligt. Frågan är om samhället valt att omedvetet tillåta denna typ av beteende och snedfördelning eller om det bara olyckligtvis har blivit så. (Less)

Various protection conditions have evolved over the years for the fashion industry, which is constantly undergoing change. These intellectual property rights consist primarily of copyright and design rights. The rights often overlap. When it comes to the protection of fashion products it has been under criticism during the past years and the protection that is offerd through law has been considered insufficient. How the fashion industry should be protected from imitation differs in oppinion.

These intellectual property rights consist primarily of copyright and design rights. The rights often overlap. When it comes to the protection of fashion products it has been under criticism during the past years and the protection that is offerd through law has been considered insufficient. How the fashion industry should be protected from imitation differs in oppinion.

Copyright requires originality and work height. The protection arises formlessly. While the pattern right imposes demands on particularity and novelty. This protection occurs through registration. The requirements set are hard-defined, which contributes to a gray zones. In practice, it has been emphasized that the fashion industry, unlike other industries, can withstand more far-reaching imitations of their creations due to the fact that the industry is always going through a change.

The protection of fashion products is related to the right to free competition in the inner market. These two interests are to some extent opposed and had ended up in imbalance. A proportionality between purpose and means would be needed. As the industry is interchangeable, rotation and competition are important, while lack of protection inhibits creative creation. The result at the present time has been that fashion products generally lack real intellectual property protection, and nearby copying is ongoing. The question is whether society has chosen to unconsciously allow this kind of behavior and distortion or if only this is an unfortunate circumstance. (Less)
