- Syftet med offentlig upphandling är att offentliga medel ska användas på ett så effektivt och konkurrensfrämjande sätt som möjligt. Det är viktigt att upphandling genomförs affärsmässigt samt att fri rörlighet för varor och tjänster inom EU främjas. Som medlemsstat i EU är Sverige skyldigt att harmonisera svensk lagstiftning med EU-rätt. Efter att ha läst Andrea Sundstrands artikel Jäv och self-cleaning i offentlig upphandling i Upphandlingsrättslig Tidskrift ter det sig inte helt klart att Sverige verkligen implementerat upphandlingsdirektivet fullt ut enligt EU:s syfte. Frågan kunde i vart fall vara föremål för vidare utredning. Regeringen menar att man genom annan lagstiftning samt med andra metoder fullgör sina åtaganden gentemot EU.... (More)

It is important that procurement is conducted commercially and that free movement of goods and services in the EU is promoted. As a member of the EU, Sweden is obliged to harmonize Swedish legislation with EU law. After reading Andrea Sundstrands article Jäv och self-cleaning i offentlig upphandling i Upprättshandlig Tidsskrift, it is not clear that Sweden really implemented the procurement directive fully according to the EU's purpose. The question could in any event be subject to further investigation. The government believes that other legislation and other methods fulfill its commitment to the EU. After examining the question, it is still not clear that Sweden meets the requirements. The legal situation is in no way established and the government's assessment differs from the referral bodies.
