Uppsatsen undersöker diskriminering av synliga minoriteter i polisiär verksamhet ur ett diskrimineringsrättsligt och polisrättsligt perspektiv. Utgångspunkten är den diskrimineringsrättsliga lagreform som presenteras i SOU 2016:87, nämligen införandet av ett generellt diskrimineringsförbud som täcker alla sfärer av offentligheten, inklusive polisens brottsbekämpande verksamhet. Uppsatsen undersöker diskriminering av synliga minoriteter i polisiär verksamhet ur ett diskrimineringsrättsligt och polisrättsligt perspektiv. Utgångspunkten är den diskrimineringsrättsliga lagreform som presenteras i SOU 2016:87, nämligen införandet av ett generellt diskrimineringsförbud som täcker alla sfärer av offentligheten, inklusive polisens brottsbekämpande verksamhet. För att analysera huruvida ett sådant diskrimineringsförbud skulle vara ett verkningsfullt redskap i att motverka diskrimineringen av synliga minoriteter lyfter uppsatsen fram tre exempel på diskriminerande praktiker från polisens sida, hämtade från tidigare utredningar och forskning om diskriminering i polisiär verksamhet; stop and search-situationer, polisbrutalitet och over-policing. Dessa exempel diskuteras dels utifrån det nuvarande kunskapsläget om sådan diskriminerings förekomst i Sverige, dels utifrån de rättsliga ramarna för polisens brottsbekämpande verksamhet. Slutligen används vissa utomrättsliga perspektiv, hämtade från feministisk och postkolonial teoribildning samt forskning om polisens yrkeskultur, för att ur olika vinklar analysera ett generellt diskrimineringsförbuds möjligheter och begränsningar i att förhindra dessa typer av diskriminering.

Undersökningen visar att de valda exemplen på diskriminerande praktiker i polisiär verksamhet till stor del möjliggörs av det handlings- och bedömningsutrymme som präglar polisens brottsbekämpande verksamhet och de informella normer som strukturerar polisens arbetssätt inom det rättsliga ramverkets gränser. Trots att polisen ofta saknar intention att diskriminera kan rutiner, etablerade arbetsmetoder och informell profilering baserad på stereotyper ge diskriminerande resultat, främst i att personer tillhörandes synliga minoriteter enligt dessa arbetssätt riskerar att i oproportionerligt hög grad utsättas för polisen misstänksamhet, kontroll och andra ingripande åtgärder. Det är uppsatsens slutsats att ett generellt diskrimineringsförbud endast i begränsad mån kan motverka dessa typer av diskriminering. (Less)
Abstract
This thesis examines the Swedish police’s discrimination of visible minorities from the perspective of both discrimination law and police law. The point of departure is the anti-discrimination law reform presented in SOU 2016:87, where a general prohibition of discrimination covering all spheres of the public, including police law enforcement, is proposed. In order to analyze whether such a prohibition of discrimination would be an effective tool in counteracting discrimination against visible minorities, the paper highlights three examples of discriminatory practices in police law enforcement, gathered from research and public reports on discrimination in police operations; stop and search, police brutality and over-policing. This thesis examines the Swedish police’s discrimination of visible minorities from the perspective of both discrimination law and police law. The point of departure is the anti-discrimination law reform presented in SOU 2016:87, where a general prohibition of discrimination covering all spheres of the public, including police law enforcement, is proposed. In order to analyze whether such a prohibition of discrimination would be an effective tool in counteracting discrimination against visible minorities, the paper highlights three examples of discriminatory practices in police law enforcement, gathered from research and public reports on discrimination in police operations; stop and search, police brutality and over-policing. These examples are discussed in relation to what’s currently known about the occurence of such discrimination in Sweden, as well as to the legal framework for police law enforcement. Finally, some extrajudicial perspectives, derived from feminist and postcolonial theories together with research on the professional culture of the police, are used to analyze the possibilities and limitations of a general prohibition of discrimination in preventing these types of discrimination.

The investigation shows that the chosen examples of discriminatory practices in police operations are largely made possible by the scope of action and discretion that characterize police work overall, as well as the informal norms that structure the police’s routines and working methods within the limits of formal law. Although the police often lack intent to discriminate, the outcome of routine procedures, established working methods and informal profiling based on stereotypes is nevertheless a discrimination of visible minorities – mainly in the form of a disproportionate amount of suspiciousness, control and other interventions aimed at these groups. The thesis concludes that a general prohibition of discrimination can counteract these types of discrimination only to a limited extent. (Less)
