Abstract
Personal assistance is a relief effort of great importance for people with disabilities. Two recent court cases, HFD 2012 ref. 41 and HFD 2015 ref. 46, have however resulted in several individuals losing their existing personal assistance and an increasing number of application rejections. It is the court’s interpretation of the term basic needs in the cases that has caused this restrictive tendency.

The aim of this thesis is to investigate how compatible the court’s interpretation of the term basic needs is in terms of the legislator's purpose of offering personal assistance in the first place. The conclusion is that there is reason to question the court’s interpretation with reference to both the law text and the draft legislation.... (More)

Personlig assistans är en viktig stödinsats för personer med funktionshinder. Två rättsfall på senare tid, HFD 2012 ref. 41 samt HFD 2015 ref. 46, har dock medfört att flera brukare fått sin assistans indragen samt att fler fått avslag på sin ansökan om personlig assistans. Det är domstolens restriktiva tolkning av begreppet grundläggande behov i de två rättsfallen som föranlett denna utveckling.

Syftet med denna uppsats är att undersöka i vilken utsträckning domstolens tolkning av begreppet grundläggande behov i de två rättsfallen förverkligar lagstiftarens intentioner med insatsen personlig assistans.
