- I takt med att internet ges mer utrymme i gemene mans vardag, utvecklas nya sätt för människor att kommunicera med varandra samt att påverka samhället. Det sociala mediet bloggar har vuxit i popularitet och närmare hälften av alla internetanvändare läser bloggar regelbundet. Genom att utnyttja sin yttrandefrihet kan människor yttra sig i många skilda ämnen. Det har även blivit vanligt att bloggare skriver om olika varumärken eller produkter. Samtidigt har olika företag insett att ett positivt omnämnande på en av de större bloggarna kan påverka försäljningen av företagets produkter. - I takt med att internet ges mer utrymme i gemene mans vardag, utvecklas nya sätt för människor att kommunicera med varandra samt att påverka samhället. Det sociala mediet bloggar har vuxit i popularitet och närmare hälften av alla internetanvändare läser bloggar regelbundet. Genom att utnyttja sin yttrandefrihet kan människor yttra sig i många skilda ämnen. Det har även blivit vanligt att bloggare skriver om olika varumärken eller produkter. Samtidigt har olika företag insett att ett positivt omnämnande på en av de större bloggarna kan påverka försäljningen av företagets produkter. Därför har det blivit vanligt att företag etablerar någon typ av avtalsförhållande med bloggare för att, i utbyte mot ersättning i form av exempelvis pengar eller gratisprodukter, erhålla ett positivt omnämnande på bloggen.
Denna uppsats har undersökt vad som gäller när bloggande personer skriver om produkter på internet – när ska det anses falla in under personens yttrandefrihet och när ska det bedömas som marknadsföring? Skiljelinjen brukar dras vid information som har ett kommersiellt syfte, med vilket menas att informationen ska avse att öka försäljningen. Ifall ett kommersiellt syfte föreligger, begränsas yttrandefriheten av marknadsföringslagstiftningen. Av betydelse kan även vara huruvida det föreligger någon form av exempelvis uppdragsförhållande eller sponsorförhållande mellan bloggaren och företaget som marknadsförs.
Oavsett om detta förhållande är uttryckligt eller tyst, bör kraven på reklamidentifiering vara strängare då marknadsföringen sker i en persons privata blogg, omgärdad av egenförfattade redaktionella texter. Konsumenter är berättigade att få all nödvändig information när dessa träffas av marknadsföringsmeddelanden, varför kraven på reklamidentifiering bör vara högre ställda då det föreligger en viss typ av avtalsförhållande mellan bloggaren och företagaren. - As the internet is becoming a more important part of the everyday life of people, there is a development of new ways for people to communicate and to influence the society. The social medium ’blogs’ have grown in popularity and nearly half of all the internet users read blogs regularly. By exploiting their freedom of expression, people can express themselves in many different matters. It has also become common for bloggers to write about different brands and products. At the same time, numerous of companies have realized that a positive review on one of the most popular blogs can affect the company sales. Therefore, it is not unusual for companies to establish some sort of contractual relationship with bloggers to, in exchange for compensation in, for example, money or free products, receive a positive reference.
This essay has investigated the situation when people are blogging about different brands and products – when should it be considered to fall under the person’s freedom of expression and when should it be considered as marketing? The borderline is usually drawn by information that has a commercial purpose, meaning that the information should increase the sales. If a commercial purpose exists, the freedom of expression is limited by the marketing legislation. It may also be significant whether there is any kind of relationship or sponsorship between the blogger and the company being marketed.
Regardless of whether this relationship is explicit of silent, the requirements of identifying the advertisement (reklamidentifiering) should be more stringent when marketing is done in a person’s private blog, encompassed by the blogger’s self-authored editorial texts. Consumers are entitled to receive all the necessary information when they meet different marketing advertisements, which is why the requirements for advertising identification should be higher when there is a certain type of contractual relationship between the blogger and the company.
