- Samerna är Sveriges ursprungsfolk och en nationell minoritet. Detta examensarbete undersöker samers rättshistoria med utgångspunkt i hur kolonialism och rasism påverkat samers rättsliga ställning. Det är en rättshistoria som sträcker sig från beskattning till paternalistiskt och hierarkiskt förhållande mellan svenska staten och samer.
Hur aktuell denna rättshistoria är idag, samt samernas rättsliga ställning i förhållande till internationell rätt behandlas också i arbetet.
De rättsprocesser som ägt rum, eller fortfarande är pågående, mellan samer och privata fastighetsägare samt samer och staten är ett resultat av den koloniala svenska rättshistorien samt lagstiftning som infördes under ’rasismens tidevarv’.

Utvecklingar har under de senare decennierna skett på ett internationellt plan som gäller staters förpliktelser gentemot minoriteter och ursprungsfolk samt att tillförsäkra dessa rättigheter. Samiska företrädare har dock uttryckt missnöje över att Sverige inte behandlar samer som ursprungsfolk i praktiken. Kritik som har riktats mot Sverige internationellt sett, samt vad som framkommer i statliga utredningar, gör att det går att ifrågasätta samernas rättsliga ställning även i dagens läge. It’s a legal history ranging from taxation to a paternalistic and hierarchical relationship between the Swedish state and the Sami.

The legal proceedings that have taken place, or are still ongoing, between Sami and private property owners, as well as Sami and the state, are the result of the colonial Swedish history of law, and legislation introduced during ‘the time... It’s a legal history ranging from taxation to a paternalistic and hierarchical relationship between the Swedish state and the Sami.
How present this legal history is today, and the Sami people’s legal status in relation to international law is also treated in this essay. The legal proceedings that have taken place, or are still ongoing, between Sami and private property owners, as well as Sami and the state, are the result of the colonial Swedish history of law, and legislation introduced during ‘the time of racism’.
In recent decades, international developments regarding state obligations towards minorities and indigenous peoples, including insurance of such rights, have taken place. However, Sami representatives have expressed dissatisfaction concerning that Sweden does not treat Sami as an indigenous people in practice. Criticism that has been directed against Sweden internationally, as well as what has been revealed in official state investigations, makes it relevant to question the Sami legal status of today.
