- Abstract
- The law about Genetic Integrity (2006:351) (LGI) regulates the insurance companies’ right to use the insured party’s genetic information for individual risk assessment. According to Chapter 2 paragraph 1 LGI, the insurance companies are not allowed to use the insured party’s genetic information when entering an insurance contract. The paragraph was introduced for protection of the insured party’s genetic integrity.
The exemption is regulated in Chapter 2 paragraph 2 LGI. The exemption mentions that insurance companies are allowed to use the insured party’s genetic information in the risk assessment if the amount of insurance compensation exceeds 30 price base amounts as a lump sum or four price base amounts as periodic payment. The exemption is regulated in Chapter 2 paragraph 2 LGI. The exemption was introduced to prevent incorrect risk assessments which could have lead to too low insurance premiums for insured parties with high risks. This previous scenario is also called the counter-selection effect.
According to the definition in Chapter 1 paragraph 5 LGI, genetic screenings are only carried out in the health care on in medical research. Genetic self-tests are not covered by LGI. The exemption in Chapter 2 paragraph 2 LGI is therefore not applicable on genetic self-tests.
The paper comes the conclusion that insured parties currently have a strong protection for their genetic integrity. The paper also concludes that information from genetic surveys should be used in the insurance companies' risk assessment to achieve an information balance between the contracting parties. There are also grounds for LGI to include genetic self- tests in order to prevent the counter-selection effect. (Less) - Abstract (Swedish)

Enligt definitionen i 1 kap. 5 § är genetiska undersökningar upprättade inom hälso- och sjukvården eller i den medicinska forskningen. Genetiska självtester omfattas inte av LGI. Genetiska självtester omfattas därmed inte av undantagsbestämmelsen i 2 kap. 2 LGI.
I uppsatsen konstateras det att försäkringssökande för tillfället har ett starkt skydd för hens genetiska integritet. I uppsatsen dras även slutsatsen att information ur genetiska undersökningar borde få användas i försäkringsbolagens riskbedömning för att uppnå en informationsbalans mellan avtalsparterna. Det föreligger även skäl för att LGI ska omfatta genetiska självtester för att motverka moturval hos försäkringsbolagen. (Less)
