- Abstract
- Since the jurisdiction of the International Criminal Court (ICC) came into
force, only citizens of African countries has been tried by the Court. This
fact has aroused anger and accusations of imperialism. This essay intends to
examine the Rome Statute, the treaty which contains the rules of the ICC.
The purpose is to see if the formulations in the statute has resulted in the
current situation. Furthermore, it tries to answer the question of whether
change is possible. That means amending without leaving the ICC
ineffective. This analysis is made with the assistance of a postcolonial
perspective.
There are many circumstances which affects the jurisdiction. This includes
which acts that are criminalised, temporal jurisdiction,... (More) - Since the jurisdiction of the International Criminal Court (ICC) came into

The purpose is to see if the formulations in the statute has resulted in the
current situation. Furthermore, it tries to answer the question of whether
change is possible. That means amending without leaving the ICC
ineffective. This analysis is made with the assistance of a postcolonial
perspective.
There are many circumstances which affects the jurisdiction. This includes
which acts that are criminalised, temporal jurisdiction, preconditions to
exercise jurisdiction and how the jurisdiction is triggered in a specific
situation. There are also articles covering issues of admissibility.
Part of the rules, like the subject-matter jurisdiction, sets fundamental
frames for the work of the court without taking aim at a certain group of
people at all. Other issues, like the powers of the Security Council, are more
complex. It is necessary for the sake of justice that a body outside of the
ICC can refer situations to the Court and thereby bind non-parties to the
statute. The real issue is more likely the political nature of the Security
Council which leads to all eligible situations not being referred.
In conclusion, there are two viable options. The first one is to strengthen the
ICC:s role against domestic courts to give the Court more credibility and
bring justice one face. If state parties can not agree to this and the ICC
continues with an operation which practically only includes Africans there
should be consequences. This can and maybe should be the establishment of
an African Criminal Court. Of course in combination with the withdrawal of

brottmålsdomstolen (ICC) har endast medborgare i afrikanska stater prövats
av domstolen. Detta faktum har väckt upprördhet och anklagelser om

bakomliggande traktaten, för att se om det är reglerna där som har resulterat

hänvisa situationer till domstolen och binda icke-parter till stadgan. Det är
snarare SäkR och dess politiska natur som leder till att alla situationer som
borde hänvisas inte blir det.
Slutsatsen är att det finns två rimliga lösningar. Den ena är att stärka ICC:s
roll gentemot nationella rättsystem för att ge domstolen trovärdighet och
rättvisan ett ansikte. Om stadgeparterna inte kan gå med på detta och ICC
fortsätter med en verksamhet som i praktiken bara omfattar afrikaner, kan
och kanske bör en konsekvens bli att de afrikanska staterna lämnar
Romstadgan och etablerar en afrikansk brottmålsdomstol. (Less)
