Den senaste tiden har blickarna vänts mot Spanien och den konstitutionella kris som för närvarande pågår i landet. I regionen Katalonien har det skett försök att separera den autonoma landsdelen från staten och efter en folk-omröstning utropades i oktober 2017 självständighet från Spanien. Med avstamp i den rådande situationen beskrivs den juridik som kretsar kring utbrytande ur stater. Det katalanska folket har flera skäl att prima facie få upphov till självbestämmande i form av en egen stat. Denna själv-bestämmanderätt, tillsammans med begreppen secession, självständighet och andra relaterade termer förklaras ur ett folkrättsligt perspektiv. Den senaste tiden har blickarna vänts mot Spanien och den konstitutionella kris som för närvarande pågår i landet. I regionen Katalonien har det skett försök att separera den autonoma landsdelen från staten och efter en folk-omröstning utropades i oktober 2017 självständighet från Spanien. Med avstamp i den rådande situationen beskrivs den juridik som kretsar kring utbrytande ur stater. Det katalanska folket har flera skäl att prima facie få upphov till självbestämmande i form av en egen stat. Denna själv-bestämmanderätt, tillsammans med begreppen secession, självständighet och andra relaterade termer förklaras ur ett folkrättsligt perspektiv. Uppsatsen avhandlar de teorier som dominerar folkrätten rörande stats-utbrytning och söker fastställa vad som gäller i en situation likt den i Spanien. Med det resultat som undersökningen ger appliceras teorierna på det konkreta fallet Katalonien för att söka avgöra katalanernas chans till en egen stat. Slutsatsen är att Katalanernas chans att få en egen stat är liten, inte bara p.g.a. juridik utan även politisk och omvärldens inställning. (Less)

During the latter half of 2017 much attention has been directed towards Spain and their current constitutional crisis. Leaders of the autonomous region of Catalonia have been campaigning for the separation from the Spanish state and in October a referendum led to the regions very own declaration of independence. With the outset being the portrayed situation, this essay describes the legal aspects of the emergence of new states from others. At a first glance, the reasons for the Catalonian people’s right to their own state may appear just and perhaps even obvious. This right, together with other fundamental notions of international law, such as secession, independence etc., is explained. The legal theories regarding the issue are discussed... (More)

At a first glance, the reasons for the Catalonian people’s right to their own state may appear just and perhaps even obvious. The legal theories regarding the issue are discussed and applied on the case of Catalonia. The overall conclusion is that a Catalonian secession isn’t anything likely in the foreseeable future.
